Since ancient times, the land issues are always important problem to the fate ofthe national property. Land is the basic resource of life for farmers, which has anextremely important significance to their life. Therefore, since the establishment ofthe new China, our Party and government have attached great importance to theissue of land and have taken a series of measures to reform the land area. Especiallyafter the reform and opening up, under the circumstances of the establishment of thehousehold contract responsibility system and the land still owned by the collectiveall cases, the farmers gain more freedom, which has increased the farmers’enthusiasm for farming and have made a rapid recovery in agricultural productionand a high development of rural economy. However, after the21st century, China’seconomy has made an over-all development and the urbanization process accelerated,the problems of the system appear gradually. Its adaptability to the developmentproductivity has decreased, which reduces of the original bonus of the householdcontract responsibility system.In this case, the shift of the land system has become an inevitable trend. Tospeed up the speed of land transfer and improve land utilization, the party and thegovernment unveiled "Rural Land Contracting Law""Decisions on major issuesconcerning rural reform and development of CPC Central Committee”"PropertyLaw" and a series of documents and laws, and gradually establish the legality of landtransfer, formulate the modes of land transfer and other issues.Especially the announcement of "Property Law", which ensures the long-termuse rights and land ownership of the framers. Strong legal basis provide circulation of agricultural land. Now, the framework of our country’s land transfer has takenshape, however, in the process of land transfer in rural areas, there are manyproblems exposed. We need a deeper study of the land transfer issues. Only acomprehensive and detailed research on this project can help us find the appropriatesolutions, so as to provide policy suggestions on utilizing rural land resources moreefficiently and promoting agricultural development to large mechanized modernagriculture.Through the elaboration on development of New China’s rural land system, thepaper concludes and analyzes the policies and rules of land transfer in rural areas,and then summarizes the status quo and problems of current land transfer system.This thesis focuses on the causes of rural land circulation problems from theinstitutional perspective of economics, and provides appropriate policies onrecommendations for the causes. For the further development of China’s landtransfer theoretically provide some suggestions and hope to have some help in theprocess of land transfer practices.
