| This paper takes the legalist thought of pre-qin dynasty as the research object,takes the spirit of rule of law,reform and prosperity contained in it as the premise,takes the reasonable core of legalist thought of pre-qin dynasty as the logical starting point,and takes historical compliance and creative transformation as the purpose.Applies the method of management to stand at the height of philosophy,a comprehensive look at the connotation of the pre-qin legalists essence and the core principles,based on the literature of qin legalist school carding and comprehensive,to explore the management philosophy of qin legalist school theme concept,generation process,internal structure,action mechanism,and the contemporary transformation,in order to dig deeper into the pre-qin legalist school management philosophy in the process of historical development and the role of human management practice and value.The aim and basic goal of this study is to deeply study the Chinese traditional management philosophy represented by the pre-qin legalist management philosophy,to extract the contemporary value of Chinese traditional management culture,to highlight the charm of Chinese management philosophy in the process of globalization,and to build a system of management philosophy with Chinese characteristics.Legalism,as a late school of pre-qin zixue,its formation process includes the absorption and inheritance of the thoughts of the pre-qin zixue,which played its due role in the historical process of qin’s unification of China,and fully demonstrated its theoretical value and management effectiveness in practice.The core of the management philosophy of legalists in pre-qin dynasty was to achieve the management goal of "governance" through the management means of "law",advocated "one should be based on law",attached importance to the establishment of rules and regulations,emphasized breaking through the old and bringing forth the new,and advocated enriching the country and strengthening the army.From the perspective of ideological origin,the management philosophy of legalists in the pre-qin period experienced the evolution process from practical law to legal philosophy.The theories of the pre-qin scholars also provided an external driving force for the formation of legalist management philosophy: the Taoist view of nature and heaven provided a theoretical basis for it,the Confucian governance model of nobility and lowliness provided a practical reference for it,and the mohist thought of shangtong provided a methodological guarantee for it.For theoretical connotation,the pre-qin legalists to follow "a fault in law" management principles,with "gruelling endued" management,combined with statecraft "live up to the name of" management,formed a "method,technique,the potential of combining the management system,from the Angle of management thought,it can be considered to be one of the source of the contemporary theory of the rule of law thoughts.For practical utility,through study of pre-qin legalists,examine system which involves the general principles of management,principles,rules,such as content,sum up its unique management,management control,management behavior of human nature and epistemology,methodology and the management theory of value,can provide the management practices of China’s new era with a development path for reference.The legalist thought of pre-qin dynasty contains the spirit of rule by law,the spirit of reform,the spirit of prosperity and the concept of power restriction.This paper is based on the following logical clues: the first chapter is a brief introduction to the concept of legalist management philosophy in the pre-qin period;The second chapter summarizes the formation process of legalist management philosophy in the pre-qin period after sorting out the historical background,internal foundation and external drive.The third chapter focuses on the pre-qin legalists in the management of human nature view,management control view,management behavior view and other dimensions of the theoretical point of view;The fourth chapter mainly discusses the management epistemology,management methodology and management axiology of pre-qin legalists to guide practice.The fifth chapter,based on the above discussion on the management philosophy of legalists in the pre-qin period,deeply explores the reasonable core of this ideological heritage and reflects,corrects and remedies it from the perspective of value,so as to realize the creative transformation of the management philosophy of legalists in the pre-qin period under the background of the new era.If Chinese traditional management thought can provide some enlightenment for the construction of the rule of law and the modernization of national governance in China,then the management philosophy thought of legalists in the pre-qin dynasty is an inescapable intellectual resource.With the building of a new era of the rule of law context,in the pre-qin legalist school management philosophy as a representative of Chinese traditional philosophy,on the basis of critical inheritance and creative transformation,at the same time,draw lessons from the reasonable elements of western modern management theory,management mode of construction with Chinese characteristics has the theory reference and the reference path.In the development process of management theory,Chinese management philosophy should have its corresponding discourse,ideas and contributions.Without the integration of traditional Chinese management culture,the world management thought will be limited to the western management tradition and lack of richness and universality.The study on the management philosophy thought of legalists in pre-qin dynasty is fundamentally aimed at supporting the cultural confidence in the construction of the rule of law in China in the new era and providing traditional intellectual resources for the management practice in contemporary China. |
