| Since 1986,the Communist Party of Vietnam has been reformed and opened to the outside world,conforming to the trend of global governance and democratization.It has responded to the demands of the people to be the masters of their own affairs and political participation,and has embarked on the road to building a socialist legal rights nation with Vietnamese characteristics.Therefore,studying the strategic initiatives for the construction of the socialist legal country in Vietnam summarizing their experiences and lessons will not only help to understand and grasp the theories of state governance and the theory of democracy and the rule of law of classical Marxist writers,but also grasps the general laws and special laws of the development of socialist politics.Moreover,it is conducive to further advancing the modernization of our country's governance system and governance capacity,improving the system of the people's ownership,and pushing the political development of socialism with Chinese characteristics in a new era to a new level.This article conductes a comprehensive and systematic study on the strategic measures for the construction of a socialist country with legal rights in Vietnam from the following four aspects:theoretical logic,development process,strategic measures,and practical results.First,it analyzes the connotation and theoretical logic of the socialist right countries in Vietnam from the three dimensions of the Marxist state theory,the Western method right theory,and the VCP's right to claim.The concept of"legal rights" comes from Western political philosophy and has a certain degree of people's sovereignty and the spirit of advocating freedom.However,Vietnam's construction of legal rights follows Marxist national theory and governance theory because of its historical limitations of bourgeois interests.Therefore,the socialist country in Vietnam,which is from the people,belongs to the people,and serves the people,has fundamental differences from the Western theory of rights.The definition of this article is:Vietnam's socialist legal rights countries are guided by Marxist state theory and Ho Chi Minh's thought,guided by Vietnamese Communist Party's political thinking innovation and inner-party democracy,guided by the organic unity of socialist democracy and the rule of law,and reformed by the National Assembly.It focuses on the reform of the Congress,the reform of the government,and the reform of the civil service system.It aims at realizing the people as the master and assuring the long-term governance of the party.It takes "from the people,the people,and the people" as the essential attributes.Second,study on the background and progress of the formation of the country's construction strategy for socialist rights in Vietnam.In the context of the construction of legal rights countries and influencing factors,the formation of strategic initiatives for the construction of the socialist legal country in Vietnam is not only an inevitable requirement for the development of a socialist market-oriented economy,but also a requirement for the building of socialist democracy,and a wave of global governance and the democratization of the world.It is the inheritance of the historical and cultural genes of the countries with legal rights.In the evolution of the construction strategy of the legal right countries,it has experienced three stages of development:the formation of ideas,the conception of ideas,the promotion of connotation,and the overall planning.Third,it conductes a comprehensive and systematic analysis and study on the strategic layout and measures for the construction of the socialist legal country in Vietnam.The construction of the socialist legal country in Vietnam focus on the overall planning,it is guided by the organic integration of democracy and the rule of law,and is based on the strengthening of the rule of law and the idea of the rule of law.It focuses on scientific legislation and parliamentary reforms,legal administration and government system reforms,judicial fairness and judicial system reforms,and the construction of cadres and civil servants.It is accompanied by an atmosphere of civil society construction and social supervision,and is guaranteed by the ruling party's transformation.In short,advance in an all-round way to form a synergy.Fourth,the author evaluates the effectiveness of the construction of a socialist country with legal rights in Vietnam and,on this basis,talked about how to draw lessons from Vietnam's experiences and lessons and promote the political development of socialism with Chinese characteristics.This article believes that the construction of a socialist country with legal rights in Vietnam is a useful exploration of how the Communist Party develops democratic politics under the conditions of one-party governance.Preliminary results have been achieved.For example,the rights of the people have been guaranteed and the power has been subject to proper supervision and control.The initial formation of the political ecology and the gradual establishment of party in law.However,there are also many problems in the construction ofof a socialist country with legal rights in Vietnam.In particular,the pace of democratic development is too fast,corruption is still serious,and the authority of the law needs to be improved.However,it also has implications for us.We must uphold the people's dominant status,nurture modern citizens' spirit of the rule of law,achieve a positive interaction between democracy and the rule of law,pay attention to the adjustment of internal and external factors in political development,and strengthen the party's leadership over the development of socialist politics.This article has a certain degree of innovation in the study of the construction of a socialist country with legal rights in Vietnam.First,it isinherently innovative that studying on the construction of a socialist country with legal rights in Vietnamfrom the perspective of party politics and party building.The Chinese academic community has conducted in-depth research on Vietnam's reform and opening up and democratization,whether it is the Vietnam Communist Party's construction or Vietnam's foreign policy,and the results have also been abundant.However,the study on the construction of a socialist country with legal rights in Vietnam has just begun,and most of them are in the stage of introduction.This article takes the strategic thinking and strategic formation process of the construction of a socialist country with legal rights in Vietnam as the main line,and conducts a comprehensive and systematic,which makes up for the deficiencies in this respect to some extent.Second,the author analyzed and studied the connotation and theoretical logic of the socialist legal rights in Vietnam from the three dimensions of the Marxist state theory,the Western method right theory,and the Vietcong legal rights claim,and put forward new opinions,which are innovative.Third,to conduct a comprehensive and systematic study on the formation of the strategy for the construction of a socialist country with legal rights in Vietnam,as well as its process,strategic layout,and its initiatives.This is the most complete and most informative achievement in the academic world.This paper also has many deficiencies and needs further deepening.For example,due to language reasons,first-hand research materials are insufficient,and most of them are used materials.In addition,the study has grasped more macroscopically,but it is not enough for the study of microcosmic details and mechanisms. |
