Recidivism is an integral part of social crime,and it has gradually attracted the attention of researchers in sociology,law,and psychology.Results of many researches on criminals in our country reveal that re-criminals are more vicious than first-time criminals,criminal means are more cruel,criminal attitudes are clearer,criminal behaviors and ideals are more difficult to correct.Therefore,recidivism is not only the type of crime that needs to be focused in social crimes,but also the difficult point in the corrections of criminals.The prisoners in the community are an important part of the re-offender community.The prevention and control of re-crime risks is also one of the key areas for re-crime risk.The research on the influencing factors of community criminals re-criminality is the prerequisite for the danger-control of re-criminals.The scope and accuracy of the study directly affect the effectiveness of the reoffending control.In order to improve the effectiveness of community criminals in re-crime prevention and control,it is necessary to carry out an analysis of the factors that influence the risk of re-offences by community prisoners.At present,researches on the risk of re-criminals of community prisoners in foreign countries,especially those in the United States,Canada,the United Kingdom as well as other countries in Europe have undergone nearly 60 years of development and the researches in this area have become more mature and constructed a complete re-criminal risk assessment index system for prisoners in communities.Due to the late start of community correction in China,although there have been quite a lot of researches on re-criminals in prisons and prisoners in China.So far,there are not many researches on re-criminals risk assessment in community prisoners.Based on these,this study intends to innovate from two aspects of theory and practice:On the theoretical level:one is to enrich the content of criminological research and promote the criminological research system to be more scientific,comprehensive and reasonable.The second is to extract the influencing factors of the risk of re-offence of the community inmates under the framework of the ecosystem theory,and to construct the theory of recriminalization of the community-based prisoners in order to provide a theoretical basis for the study on the influencing factors of community prisoners in China.The third is to provide theoretical guidance to our country's judicial authorities in formulating the criminal legal policies concerning people in the community.At the practical level,the first is to carry out research on the influencing factors of community prisoners' re-offense through empirical research methods,so that the community correction work is based on scientific investigation and research,and the quality of community correction work is improved;secondly,the risk prediction of community crimes for re-offenders is constructed.The model aims to further improve the scientific level of prevention and control of re-offending risk in the community.The research object of this study is divided into two groups:(1)Shanghai's re-offenders who have experienced community corrections.The author,with the support of the Shanghai Municipal Community Corrections Administration and the Shanghai Prison Administration,produced a sample frame for the re-offender community prisoners through comparison and row-out.Through a random sampling method,165 community corrections were eventually chosen.Experienced re-offenders.(2)Community prisoners in Shanghai who do not have a re-crime experience.In the list of prisoners who have not re-offended in the community provided by the Shanghai Municipal Bureau of Justice Bureau of Community Corrections,the author selected a total of 173 community inmates who are not re-offender by random sampling.This study conducted a comparative study of re-offenders and non-re-offenders in community prisoners and used the SPSS 20.0 statistical software to conduct a descriptive analysis of the relevant circumstances of re-offending community prisoners and those who did not re-offenders in the community.Logistic regression analysis extracted 26 influential factors of community re-offense risk of prisoners,and further constructed a community prisoners re-crime risk prediction model.This study draws the following conclusion:From a microscopic perspective,the relationship between the community's inmates before their 14th birthday and their parents,and the school's performance are of great value in exploring the reasons for reoffending.In addition,the community's education level of prisoners,the number of participating in criminal activities,the unfortunate events encountered during community corrections,and the employment situation during community corrections are of great value to the prediction of re-offense risks.Judging from the meso level,the working conditions of the prisoners in the community and poor social interaction are likely to lead to their re-offense,while the macro-level related factors have no significant effect on the community re-offenders.Finally,based on the results of empirical analysis,this paper summarizes and discusses the influencing factors of the reoffending of the prisoners in the community,and looks forward to the subsequent further expansion studies.
