The stable development of national economy based on progressing banking industry,however,the characteristic of “high liabilities,high risk” that banking industry was born in nature,leading to the countries of the world had to strict regulatory strategies.With the booming of market economy,the demand for financial services of social economic entities revel a trend of diversification.Sticking to traditional lending business can only reduce the income and business scope of the banking industry.In this context,the choice of change and innovation,in order to adapt to the diversified needs of the social and economic subjects,is mainly manifested in the opening of the scope of the banking business,covering the whole financial market,and gradually evolving into an "all-around bank" with comprehensive management.The comprehensive management of banking industry has not reduced the risk caused by the "high debts" from the banks.Instead,it will have a more serious risk of gap and mismatch accumulation with the traditional regulatory strategy and mode,as a typical example of the financial crisis that revels in 2008.In view of this,the prevention and control of risks arising from integrated banking operation should be a serious topic in the construction of financial rule of law.The core mission of a banking supervision system is to effectively prevent and control the risks of the financial market,to ensure the stable and healthy development of the financial system,and to provide continuous support for the development of the real economy.Although the comprehensive management of commercial banks in China is the result of market selection,it has accumulated a large amount of financial risk at the same time to meet the needs of the diversified financial services of the social and economic subjects.The Party Central Committee and the State Council attach great importance to it,and put forward to strengthen financial regulation and keep the basic requirements of no systemic risk.This is not only the most important subject of our financial work,but also one of the major issues of the regulatory authorities.At present,the key problem is that when the regulatory system based on the division of supervision is the main framework,the supervision strategies,ideas and ways would likely do little when facing the risks of the management of commercial banks.It can be said that the departure and contradiction between the two is the logical starting point for financial supervision eager for seeking change.Based on the above conclusion,this paper selects the economics of law as the research perspective,and takes the objective risks derived from the comprehensive operation of commercial banks as the foundation.Adopting the argumentative framework of "theoretical basis,historical evolution,realistic situation,supply and demand analysis,cost-benefit analysis,extraterritorial experience,scheme perfection",and using the relevant theories of the economics of law,such as supply and demand theory,cost-benefit theory,equilibrium theory,institutional change theory,the system of integrated operation and supervision of commercial banks to formulate the study the comprehensive operational supervision in China.By summarizing and combing the historical evolution of the integrated operation supervision system of commercial banks,this paper concludes that ensuring financial security and improving financial efficiency are the major forces to promote the change of the integrated operation supervision system,and points out that the integrated operation supervision is the future trend,not the original separate operation supervision.Based on the analysis of the inevitability and realization of integrated operation,this paper summarizes the four characteristics: cross-department and cross-product in a cross-market scenario,complex transaction structure,weakening the efficiency of financial regulation,and financial innovation.Through the analysis the unbalance of supply and demand in the comprehensive operation supervision system of commercial banks in China,this paper combs out five characteristics: the reality of financial integration and the incomplete in an unbalanced supply system,the rapid development of financial innovation and the unbalanced supply of the regulation supervision system,the unbalanced supply of cross-industry business characteristics and the unbalanced supply of the separate supervision system,the easy-to-occur systematic risk and the insufficient supply of risk in the macro-prudential regime,and the financial consumer rights protection and non-equilibrium of the insufficient supply of the system.The five characteristics point out the direction for the reconstruction of the supervision system in the future.Through the cost-benefit analysis,this paper makes an empirical test on the effectiveness of the comprehensive management and supervision of commercial banks.Its benefits lie in preventing the operational risks of banks,its costs lie in the possibility of affecting the economic scope of commercial banks,the possibility of the loss of efficiency,and the arrangement of financial supervision system should be considered the trade-offs between financial security and financial efficiency.This paper also introduces the advanced experience of comprehensive operation supervision of commercial banks in developed countries in terms of macro-prudential supervision system,principle supervision orientation,and financial consumer protection supervision,with a view to providing reference for the adaptive reform of supervision in China.Based on the experience,this paper puts forward a macro-to-micro perfect scheme,which includes not only the concrete construction of principle-oriented supervision,but also the new supervision framework focusing on cost-benefit,supervision coordination and risk early warning,the concrete supervision norms of different business models and the construction of supervision system for the protection of financial consumers' rights and interests.It is expected that the perfection of the supervision system will provide a steady flow of impetus and support for the development of real economy in China.
