The Study On The Legitimacy Of The International War

Human society can be considered as a history of civilization development and a history of frequent wars.Since the Westphalia system was established,the countries,on the one hand,made wars much more purposeful.At the same time,their power became more concentrated,and the scale and fields of the wars extended unprecedented.However,with the increasing development of international social interaction,especially the evolution of globalization,the international shared values,international organizations,institutions and regulations have got significant achievements.As a consequence,wars are becoming more and more domesticated,following the regulations in accordance with the laws.Wars,which are against morality and justice,have lost their places in international society.The pulse of War's legitimacy and legitimate wars becomes clear and strong.It is the inevitable outcome of the development on international political civilization,from the concepts of value,social approval to international regimes.Each kind of the essential factors can raise the peace,as well as wars.Under the conditions of peace,the study on legitimacy of wars and legitimate wars aims to maintain long-term peace,because it will be cut by bullets at any time.The existence of illegitimate wars makes it much more difficult to protect human beings for legitimate wars.The over-optimistic thoughts of peace are actually man-made and self-used anesthetics.Even a war which can establish the world pattern is unlikely to have permanent effects,because the victory is always the assets easy to lose,and the changes of the peace will make all beyond recognition.Therefore,according to the logical chain of what is the legitimacy of international wars,what are the origins and bases of the legitimacy,how to judge and how to guide the practical,after an in-depth study on theories of wars,a check analysis of some war cases such as Gulf War,War in Afghanistan and the Iraq War,and a discussion on the problems of reality,this article holds that the legitimacy of international wars has distinct characteristics which are different from domestic political legitimacy,and plays an important role in judging the victory or defeat of wars,enhancing national soft power and developing international society.All the studies are based on the perspective of international politics sociology.Three origins of the legitimacy of wars are: concept of value,international regimes,and approval on consensus.Wars,based on concept of values,are often encouraged by social construction and aim to adhere and maintain the inner ideology of international shared values or regulations,and strive for moral,beliefs and identities.As a result,they are considered to have value legitimacy.However,wars,based on international regimes or approval on consensus,are often encouraged by rational choices,decided and estimated by cost-income principle.Because they aim to reduce the cost and increase the income,consequently,they are considered to have tool legitimacy.From the analysis above,we can see that value legitimacy and tool legitimacy can be mixed together,as well as coordinated difficultly.Different situations have different degrees of legitimacy.Sufficient legitimacy,defective legitimacy,deficient legitimacy and bereaved legitimacy are creative estimating grades according to the basic power's characters of legitimacy of wars.Legitimacy of wars has Three basics and Four Grades.Just wars,self-defense wars,wars by regulations and multilateral wars have its different degrees on legitimacy,but the legitimate grades and legitimate conflicts among them remain to be further understood or overcome.Soft power is the social effect of hard power and it is fully contained in legitimate and multilateral wars.When countries are facing the pressure of legitimate wars,the theory of legitimacy of wars can be the instruction,contributing to dialectically grasp the legitimacy of war opportunities.In short,during the current days with the surge of globalization,the forms of the wars trend more divers: traditional and non-traditional,open and hidden,huge and scattered micro,violent and low intervention.We can see that wars are not dead,or even dying,the essence of wars has not been changed at all.So,we can't stop thinking about the legitimacy of wars,and the need for legitimate wars sometimes cannot be substituted,because the power of justice and law will never low noble head to the evils.
