Research On Inspection System From The Perspective Of National Governance Modernization

The modernization of national governance is the overall goal of deepening the reform in an all-round way of our country,and its basic symbol is the national rule of law."The Chinese Communist Party Central Committee's Decision on a Number of Important Issues in Relation to Comprehensively Implementing Governing the Country by Law" passed in the fourth Plenary session of the 18th Central Committee of the Communist Party of China put the inner-party laws and regulations into the socialist rule-by-law system clearly,emphasizing that the inner-party laws and regulations are not only the important basis for governing the Party,but also the strong guarantee for building a socialist country ruled by law.The Inspection System of the Party is an important part of the laws and regulations within the Party.It is the"sword for anti-corruption" and "the weapon for governing the country" to strengthen the construction of the ruling party and the construction of a clean government,and to promote the overall and strict governance of the party and the rule of law.The history of the world shows that power corruption is an important factor that hinders the modernization of national governance.Serious power corruption can lead to the crisis of national governance.Therefore,how to curb and eliminate corruption to achieve effective supervision on public power has become a major issue faced by the modernization of national governance.In China,the relationship between the Party and the rule of law is the core of the construction of the rule of law.The leadership of the Party is the most essential feature of socialism with Chinese characteristics,the most fundamental guarantee of the rule of law in socialism,and the decisive force of the national governance structure.Based on the party's leading and ruling position,and the political structure with Chinese characteristics,which is highly integrated between the party and the country,the party's own construction directly determines the operation of the state's public power and the state's rule of law,and also directly determines the modernization process of the state's governance.Meanwhile,according to the general requirements of "full coverage" and "full-scale inspection" of inspection work,this inner-party inspection has actually overflowed into a kind of national inspection.Therefore,studying the inspection system from the perspective of modernization of national governance is undoubtedly of special significance to the innovation of national legal theory and the promotion of legal practice in China.Guided by the Marxist stand,viewpoint and method,and starting from the basic theory and internal connection between the inspection system and the modernization of national governance,the article briefly clears the historical evolution of the ancient inspection system,the inspection system of the extraterritorial inspectors,and the inspection system of the Party.On this basis,it further analyzes the constituent elements of the system and its functional orientation,and discusses the system's triple functions of anti-corruption,governing the party and the country from the perspective of the modernization of national governance.Based on the practice of anti-corruption and the actual inspection work,it summarizes the achievements,challenges and causes of problems in the system's practice,and makes a concrete discussion on the perfection of the inspection system from the aspects of rule of law,mechanism and practice.It holds a view to construct a set of inspection system and related theories that are complete in system,scientific in mechanism and feasible in operation in response to the requirements of the modernization of national governance The paper is divided into the following seven parts:The first part is introduction.First of all,it clarifies the background and significance of this paper,and puts the Party's Inspection System under the perspective of the modernization of national governance to carry on research and analysis.Then,this paper systematically combs the research status of national governance modernization and Inspection System at home and abroad,analyzes and comments on the present research situation,on the basis of that it puts forward the ideas and methods of this paper.Finally,the innovation and deficiency of this paper are put forward.The second part is about the inspection System and national governance.This chapter first explains the concepts and theories related to state governance and the construction of the ruling party under the background of ruling the country according to the constitution and the rule of law.At the same time,the concordance between the modernization of national governance and the construction of the ruling party is discussed in detail.Then it discusses that national rule of law is the basic symbol of modernization of national governance.On the basis of clarifying the concepts,characteristics and functions of national rule of law and modernization of national governance,it specifically analyzes the role of national rule of law played in the modernization of national governance.Finally,the inspection system,as an important inner-party law,is an important part of the construction of socialist rule of law system,which links the Inspection System with the socialist rule of law and the modernization of national governance.The logical relationship among them is expounded in detail,and the positioning and function of the Inspection System from the perspective of modernization of national governance are demonstrated.The third part is the historical investigation of the inspection system.This chapter is mainly based on the historical practice of national governance.Starting from the historical evolution of the system,it systematically clears the historical evolution of the ancient inspection system,the inspection system for the extraterritorial inspectors,the party' inspection system,and the roles they have played in national governance.Firstly,it demonstrates the main stages,main characteristics and limitations of the system in ancient times.Historical conclusions and enlightenment are drawn.After that,it inspects the emergence,development and main characteristics of the system,an extraterritorial inspector,and draws conclusions and enlightenment that are in line with China's national conditions.Finally,it mainly researches the development and changes of the system and its main characteristics and conclusions in the three historical stages of the Chinese Communist Party:the period of revolution and construction,the period of reform and opening up,and the period from the 18th CPC National Congress.The fourth part is the analysis of the elements of the inspection system.Starting from the concrete operation of the system,this chapter mainly studies and analyzes multiple elements of the system such as the subject and object,content authority,methods and procedures and their logical relations.Firstly,it describes the type and responsibility of the inspection subjects,then analyzes those of inspection objects,and differentiates and analyses the relationship between the objects and objects.Secondly,it discusses the content and authority of inspection.Thirdly,the way and procedure of inspection and the basic situation of its operation are analyzed in detail.The fifth part analyzes the governance function of the inspection system.This chapter mainly studies and analyzes its functions in the process of national governance modernization,respectively on anti-corruption,inner-party governance and public social governance.First of all,it analyzes the authority,initiative,directness and comprehensiveness of the system as a sharp sword in anti-corruption,which enables the system to play an important role in preventing corruption in advance,blocking it in the process and rectifying it afterwards.Secondly,it analyzes the specific value of the inspection system.As the only top-down supervision system in the party,that mainly targets middle and high-ranking cadres,it has played an important role in improving the party's self-purification ability,strengthening the party's political construction,improving the party's supervision system and consolidating the party's ruling position.The system has become a sharp weapon in the party's governance.At last,it analyzes that as the most important instrument in governing the country,it has a special position and plays an important role in power supervision,unblocking public opinion to relieve people's hardship and social public governance.The sixth part is the practical examination of the inspection system.Starting from the inspection practice since the reform and opening up,especially since the 18th CPC National Congress,this chapter summarizes and analyzes both the positive and negative experiences of the system in the anti-corruption practice with Chinese characteristics and the actual inspection work.Firstly,it summarizes the main achievements of the system and its causes.Then it analyzes the practical challenges that the system faces,such as relatively lagged theoretical construction,imperfect organizational system,slacking operation mechanism,lack of innovation in inspection methods,and insufficient application of inspection results.After that,it makes an in-depth theoretical analysis of the causes of the problems existing in the system.It mainly demonstrates the reasons,such as lagged political system reform,unequal power of inspection subject and object,and quality insufficiency of inspection personnel.On the basis of the above research,the paper finally discusses the perfection and improvement of the inspection system,and specifically discusses the conception of methods from the level of design,which is the top-level,the level of legal system and the level of operation mechanism.It provides some view for the development of inspection system both at present and in the futureThe seventh part,based on the study of the inspection system practice,the resear ch and discussion on the improvement of the inspection system are carried out.It is be lieved that the central will should be strengthened from the highest level of practice,t he execution of the inspection system should be improved,the central and local inspec tion work should be connected closely,the integration of inspection system and other methods should be deepened,and the application of the inspection results should be w ell functioned;from the aspect of laws and regulations,the integrity legal system and t he laws and regulations related to inspection work should be further established and i mproved;from the aspect of operational mechanism level,the system of information r esource sharing,selection and management mechanism of talents in inspection,the p erformance appraisal and evaluation mechanism of inspection work,and the research and innovation mechanism of inspection theory should all be further established and i mproved.All of the hard work is to lay foundation for further discussion in perfecting the inspection system,and to offer a limited outlook to the development of inspection system both in the present and a period time of the future.The eighth part,also the conclusion part,mainly summarizes the research process of this paper,and makes some thoughts and suggestions on the great development of the inspection system in the process of national governance modernization in the future.
