Model Innovation,Path Selection And Performance Impact Of External Corporate Intellectual Property Exploitation

As an intangible asset,intellectual property has become one of the important strategic resources for enterprises to gain competitive advantage and create values in the age of knowledge economics.In an open economic context,intellectual property is transformed from legal assets in traditional mode into trading strategic assets.How to improve the financial performance and strategic performance through external intellectual property exploitation has become one of the key issues in the field of intellectual property operation and management,and has been highly valued by the theoretical and practical circles.China is an emerging market country of intellectual property rights.Chinese enterprises pay more attention to the internal protection of intellectual property rights and their defensive legal value than external exploitation and their open strategic value.As a result,intellectual property rights,especially patent applications and authorizations,proliferate along with low patent conversion rate and patent sleep phenomenon.A large number of "sleep assets" fail to maximize their potential value,which indicates that intellectual property has great potential for external exploitation.At the same time,the diversity of participants in the intellectual property market,the existence of patent jungle phenomenon and patent portfolio application generally make it more difficult for enterprises to conduct patent external exploitation solely by their own resources and ability.In view of these phenomena and problems,the studies on the mode innovation and path selection of enterprise intellectual property external exploitation are put forward.In view of these phenomena and problems,the proposition of the model innovation and path selection of the external exploitation of intellectual property is put forwarded to make up for the deficiency of passive utilization and path is unclear of traditional intellectual property exploitating model under the open and shared economy,and construct the active and open intellectual property structure exploitation model,and explore the problems of external exploitation model innovation and path selection of enterprise intellectual property.Based on the questionnaire survey data,the relationship between the key variables of the external exploitation of intellectual property will be empirically analyzed,providing theoretical support and empirical evidence for further exploration of intellectual property operation and management.Based on the above research purposes,firstly,through analyzing the relational chain between the external exploitation of intellectual property and the innovation of business model,the research object and scope are determined,the concepts of intellectual property extermal exploitation,desorption capacity,technical system,technology market intermediary are defined,and literature review on external exploitation models,exploitation path and exploitation performance of intellectual property at home and abroad is carried out in detail.The patent life cycle management model theory,misfit asset commercialization theory,intellectual property exploitation portfolio selection theory,desorption capacity theory are used to study the model innovation and path selection of external exploitation of intellectual property rights,and the interrelationships between external exploitation drivers,desorption capacity,exploitation model and external exploitation performance of enterprise intellectual property are interpreted;Finally,the hypothesis problem and the model are tested with the method of structural equation model analysis.At the same time,the problems are analyzed that desorption capacity played a mediating role in the relationship between driving factors and external exploitation performance and that the exploitation model had an adjustment effect.On the basis of theoretical analysis and empirical tests,the thesis puts forward the following research conclusions:(1)Intellectual property,especially patents.is not only a legal def-ense,but also a flexible tool that serves a variety of different strategies,which have multiple applicable logic such as exclusive logic,defensive logic,market logic,partnership logic and open(open source)logic.The characteristics of technology regime(the invisible and coding nature of the knowledge base.the simplicity and complexity of technology,the existence of network effect,modularity and integration nature)and its dynamic evolution can influence the application logic of the patent,which further affecting the optimal strategic choice of patent exploitation.The research results theoretically expand the dynamic perspective of intellectual property exploitation,and provide practical reference for the choice of-enterprise intellectual property exploitation model and value realization strategy.(2)The study finds that as a patent market intermediary organization with a unique business model,patent aggregation operating companies is helpful to solve the problems of lack of complementary resources,inadequate desorption capacity.high transaction costs and low efficiency faced by enterprises in implementing extenlal exploitation of intellectual property rights alone.The external exploitation of intellectual property rights by using patent aggregation operating companies can not only create short-term or long-term monetary and non-monetary value for enterprises.but also create potential value in market cultivation and market interaction.resource enhancement and cost-effectiveness improvement,decision-making quality improvement and risk reduction.(3)Empirical research based on the survey data of Chinese enterprises show that the drivers of intellectual property external exploitation(exploitation incentive,organizational structure.technology market and partners)have a significant positive correlation with extermal exploitation performance,and desorption capacity has nediating effect in the relationship of the influence of driving factors on exploitation performance,and the exploitation model(direct or indirect)have no regulatory effect in their relationships.Innovations are mainly reflected in:First,based on the analysis of the impact of technological regimes characteristics and its dynamic evolution on patent application logic,a research framework combining static and dynamic is established,and t the external patent exploitation,node and value realization strategy from the perspective of cross-organizational boundary was clearly put forward.which made up for the deficiency of relevant domestic research.Secondly,based on the competency,rewards and breadth of transaction,the three-dimensional classification model of the business model of patent aggregation companies is constructed.On this basis,the management framework for the patent external exploitation of patents is established,which enriches the content of enterprises' intellectual property external exploitation and management innovation practices.Thirdly,the relationship between key variables of external intellectual property exploitation was empirically verified based on the questionnaire data,and a small number of existing empirical research literatures at home and abroad were expanded to investigate the relationship between related variables of external intellectual property exploitation?providing theoretical basis and data support for further relevant studies in the future.
