Research On The Construction Of Socialist Legal Culture With Chinese Characteristics

Building a country ruled by law and comprehensively administering the country according to law are important goals of the socialist modernization drive with Chinese characteristics.The socialist legal culture with Chinese characteristics is the spiritual connotation and cultural support of a country ruled by law.Therefore,the construction of socialist legal culture with Chinese characteristics is not only an important content of Marxist sinicization research,but also an important issue in the theory and practice of socialism with Chinese characteristics.Since the Reform and Opening Up,the building of socialist legal culture with Chinese characteristics has continued to move forward,and historic achievements have been made in promoting the building of a socialist country under the rule of law with Chinese characteristics.Since the 18 th national congress of the communist party of China(CPC),it has become an important task in building socialism with Chinese characteristics in the new era to deepen the construction of socialist legal culture with Chinese characteristics and accelerate the building of a socialist country under the rule of law.However,as a cultural support for the construction of a socialist country ruled by law with Chinese characteristics,the current status quo has problems such as uneven development levels,imperfect mechanisms and systems,a less popular law atmosphere,and insufficient self-confidence.The construction also faces constraints such as the limitations of historical and cultural traditions,imbalances and socio-economic development,the complexity and diversity of ideological struggles,and the realities of regional demographic factors,which cannot fully satisfy the socialist rule of law supporting Chinese characteristics requirements for national construction.Therefore,it is very important and necessary to study its basic concepts and theories,explain its origin and theoretical basis,summarize its historical achievements and basic experiences,analyze its plight and causes,and explore its countermeasures and implementation paths.Based on this,this thesis always follows the basic principles and guiding ideology of Sinicization of Marxism.While adhering to the basic position,principles,and methods of Marxism,it is based on China's national conditions and the needs of the times.By explaining the scientific connotation and theoretical basis about the construction of socialist legal culture with Chinese characteristics,this thesis sums up its development process and historical experience,analyzes its main problems and basic reasons,and puts forward basic countermeasures and forward thinking.This will deepen the understanding about the scientific connotation of socialist legal culture with Chinese characteristics,promote its construction thinking,accumulate its construction foundation,enrich its construction theory,and promote the practice of socialist legal culture with Chinese characteristics.This thesis consists of an introduction,a main body,and a conclusion.The main body consists of five chapters:The first chapter explains the concept and basic theory about the construction of socialist legal culture with Chinese characteristics.It explores the legal culture from its source andanalyzes the meaning of the concepts related to the legal culture.On this basis,the concept about the construction of socialist legal culture with Chinese characteristics was proposed.The connotation about the construction of socialist legal culture with Chinese characteristics includes the discrimination of its subject and object and the description of its characteristic.This chapter explores the content about the construction of legal culture from four aspects:material,spiritual,system and behavior.This chapter also summarizes its objective laws and points out its strategic value.The second chapter traces the basis and theoretical reference about the construction of socialist legal culture with Chinese characteristics.The construction of socialist legal culture with Chinese characteristics has deep theoretical roots.Marxist theory is the basis about the construction of socialist legal culture with Chinese characteristics,while Chinese traditional culture and Western rule of law civilization are its reference.The Marxist classic thinker's thought about rule of law and the construction about the rule of law by the main leaders of the Communist Party of China constitute the theory inherent in the construction of socialist legal culture with Chinese characteristics.Ancient Chinese and Western civilizations are the important references for the construction of socialist legal culture with Chinese characteristics.The third chapter summarizes and reviews the history and experience about the construction of socialist legal culture with Chinese characteristics.It focuses on the basic process,main achievements and basic experience in the construction of Chinese legal culture.The history of Chinese legal culture construction follows the timeline about the period of the new democratic revolution,the period of socialist revolution and construction,and the new period of Reform and Opening Up.It summarizes the remarkable achievements of Chinese legal system improvement,legal theory expansion,and people's legal identity.At the same time,it deeply analyzes the important experience about the construction of socialist legal culture in adhering to the basic national conditions,giving full play to the spirit of reform and innovation,correctly handling the relationship between the party and law,the power and law,and the persisting in the two "Trinity".The fourth chapter analyzes the predicaments and constraints about the construction of socialist legal culture with Chinese characteristics.We should look for deficiencies while affirming our achievements,so as to comprehensively reflect the overall picture of the legal culture construction.Difficulties exist in the development of legal culture construction,institutional mechanisms,atmosphere for popularizing the law,and belief in the rule of law.There are both the constraints of objective factors and the constraints of social history.Facing the root causes of the problems about the legal culture construction,it provides solid support for the next step of in-depth exploration of ideas and methods to solve the problem.The fifth chapter discusses the countermeasures and forwards thinking about the construction of socialist legal culture with Chinese characteristics.Given the current situation about the construction of legal culture,this chapter puts forward program opinions around six perspectives: ideology,system,practice,culture,resources and international.It also exploresthe construction of legal culture from the aspects of multiple motivations,responsibility supervision,law popularization,cultural innovation,talent cultivation,and the rule of law evaluation mechanism.Finally,from the three main lines which are goal orientation,practice requirements,and development direction,this paper makes a forward-looking reflection on future development about the construction of legal culture.
