| With the aim to find out the reasons caused mine calamity and preventive actions, the text applies the institutional analysis method to the discussion from the view of public management, law and administration supervisions, and economic transition. The reasons on public management that caused mine calamity are as following: weak mine management through traditional public management method, the distortion of merit and encouragement system for officials, and the chaos of responsibility mechanism. All the above defects demonstrate the weak management under a strong government, only"apparent achievements"checked by merit system, and cause GDP partiality and responsibility ambiguity of parties on mining management. In addition, the reasons on supervision are mainly that our country is in a transitional phase from"rule by men"to"rule by law", so that our legal environment is not perfect and legislation and law execution cannot wheel into line with each other. Due to the imperfect law supervision, the supervision on mining is still used through administrative method, which hasn't been adapted to the varying mine management. At last, the weakness and failure of public management and supervision system on mining management is shown in a form of mine calamity in the period of economical transition. So the system on mining management should be innovated on mining management to prevent from mine calamity effectually. Institutional innovation can bring mining management into the orbit of institutionalization and standardization. The mine calamity can be prevented and decreased through ensuring miner's liberty of speech, perfecting merit and encouragement system for officials and improving mining public management system gradually. In terms of the supervision system, it should be that mines are governed by law and bring the law's stability, enforcement and objectivity into full play. Administrative supervision exits the leading position gradually. Meanwhile, the supervision method also should have some innovations. For example, let the third party supervise; apply a new supervision way from"top-down"to"bottom-up"etc. What's more, from the view of crisis, mine calamity management should establish an emergency response management system, which will make the mine calamity's prevention, rescue and treatment also realize institutionalization and standardization. |
