| Since the reform and opening-up policy applied, Chinese people have made agreat achievement startling people in the other part of world. But hided by the honor,there is a problem that the work safety is serious in China. It is said that in recent years,there are about 140,000 workers died from one million accidents per year. The frequentwork safety accidents not only lead up to a big loss, but also had the dead workers'families agonized, which threat the construction of harmonious society. TheMarket-failure leads up to the birth of work safety regulation. As China has beenconstructing the modern regulatory state, the study of work safety regulation considersas significance. Now, the studies on the social regulation are less than the studies oneconomic regulation in China, and the studies on the work safety regulation are evenfewer.In order to study on the governmental work safety regulation in China, this paperuses comparative method to analyze the status of work safety regulation in China forfinding out the deficiency of China's work safety regulation. Finally, the author givesthe suggestion of improving the work safety regulation in China.This paper consists of three parts.In the first part, the definition of work safety and the responsibilities ofgovernment to regulate work safety are addressed. In the part, the definition of worksafety is addressed firstly. Secondly the author compares the two definitions betweenOHS and work safety. Thirdly, the governmental regulation is discussed and thenecessity of work safety regulation is concluded through an economic andadministrative analysis.In the second part, the author states the evolution of work safety regulation inChina and U.S. Then the author analyses the characteristics of work safety regulation in the two countries. Finally, the problems in China's work safety regulation arefounded.In the third part, the author gives the suggestion to improve China's work safetyregulation.
