Wetland is both the richest biological diversity on the Earth's ecosystems and the most important living environment for the human .It not only provides a wide range of resources for people's livelihood and production, but also has enormous environmental function and efficiency. It can save excessive water from precipitation and river to avoid flooding, so it is called a natural "sponge". Besides, it is also the natural "pool filter" for human production and domestic sewage, that is because of its water purification, which can clear the soil of nitrogen and phosphorus pollution, At present, the area of wetlands is only 2%-3%, but its capacity of carbon sequestration is up to 25%-30%, which plays an important role on the problem of the carbon cycle .The international community has payed great attention to the study of wetlands, and have done a lot of thorough study in the wetland protection and management, the wetland development and evolution, the wetland ecosystem and the dynamic ecological processes, the biodiversity conservation of the wetland, the wetland degradation mechanisms, the degradation of wetland restoration and reconstruction, the construction of artificial wetland, the wetland evaluation, monitoring and technology issues, all of which are important value to our wetland protection.Nowadays, with China's urbanization and industrialization develop rapidly at an unprecedented speed and scale, the environmental problems increase remarkably and the wetland protection becomes more importance.Under this circumstance, the article studies the the Research on the legal problems of the protection of Gannan Wetland of the upper Yellow River First of all, from the protection of the wetland and the perspective of the law, it studies the status of Gannan Maqu wetland of the upper Yellow River, analyzes the existent problems and reasons ,and points out the gaps in the wetland protection and the legal systems though comparing with the western developed countries, then, relied on the local conditions and the wetland protection regulations of Gansu province, it learns from the successful experience of wetland protection abroad ,and has a systemic concept of the Gannan wetland of the upper Yellow River, which contains seven specific legal measures, including improve legislation of wetland protection, formulate specific regulations of Gannan wetland, establish and improve the relevance of specific protected legal system, strengthen the legal publicity of wetland protection, enhance the awareness of wetland protection in the whole society, set up an ecological compensation mechanism of Gannan wetland, increase capital investment in the protection of Gannan wetland and adjust the using patterns of wetland resources . Doing these is to play the legal and policy role to protect wetland, and to achieve the purpose of protecting Gannan wetland better and using it sustainablely, additionly, to promot the legal system theory construction of ecological environment.
