Study On The Legal Mechanism Of Wetland Ecological Compensation In The Yellow River Delta

Wetland is a transitional ecosystem between land and sea.Because of its unique functions,wetland is very rich in natural ecological landscape,and plays an important role in the development of social economy and the stability of the ecological environment.However,the wetland ecosystem is vulnerable to the interference of external factors and self repair ability,coupled with the rapid population growth and unlimited resources development,and the existing wetland protection legal system is not perfect,resulting in China's wetland area reduction and ecological decline,also further threaten the sustainable development of social economy.It is based on this situation that the legal mechanism of wetland ecological compensation arises at the historic moment.Under the background of vigorously developing highly efficient economy in China,the strategic goals of "Huang Lan" two districts have been implemented in the the Yellow River Delta area,which has brought great opportunities for the coordinated development of ecology and economy in the region.Therefore,the important role of Shan Dong province government is fully aware of the ecological compensation mechanism in wetland protection,and hope that through the legal form of the system of ecological compensation is established,regulation of wetland development,effectively protect the wetland ecosystem stability,so as to realize the good situation of resource development and economic construction of harmonious development.This paper studies the legal mechanism of wetland ecological compensation in the Yellow River delta from the perspective of environmental law,which is divided into four parts as follows:The first part is the interpretation of the connotation of wetland and wetland ecological compensation at home and abroad.On the basis of this,combined with the nature of the Yellow River delta wetland,it makes a reasonable definition of the relevant concepts,and provides reference for future research progress.And from the ecological,economic and legal theory as the guidance,in order to build the the Yellow River delta wetland ecological compensation legal mechanism to seek theoretical basis.The second part is strategy of economy development and based on this background,the investigation of wetland resources in the Yellow River Delta and the study on protection andecological compensation situation,summed up the main problems,and analysis of the Yellow River delta wetland ecological compensation dilemma from the perspective of law.At the same time,we need to analyze the necessity and feasibility of establishing the legal mechanism of wetland ecological compensation under the "yellow blue" two zone strategy,so as to achieve the ultimate goal of the coordinated development of ecological protection and economic construction.The third part selects the three countries in the US,Britain and Brazil as the research object of the wetland ecological compensation legal mechanism outside the country,and analyzes the construction of the legal system,ownership of property rights,wetland ecological compensation mode and management system.At the same time,this paper also learned from the practice experience of wetland eco compensation in some provinces in the region,in order to drive the coordinated development of wetland environment and ecological economy in the Yellow River Delta.The fourth part is the focus of this paper.By defining the main body of compensation,broadening the channels of funds and realizing multiple compensation forms,we should refine the internal mode of the Yellow River Delta wetland ecological compensation legal mechanism.In view of the current wetland compensation management system,we should clarify the regulatory authority of the government departments,absorb the public participation force,and strengthen the supervision of the implementation of the legal mechanism of wetland ecological compensation.At the same time,we should broaden the way of judicial remedies,and build a unified and clear framework for the legal system of wetland ecological compensation,so as to effectively manage and protect wetland resources and ecological governance.
