The current situation that our country government supervise rural environment is not very optimistic,which makes our country rural environmental problem become increasingly serious.At present, China's environmental protection provisions of the Basic Law has not clear regulations towards the responsibility of the government.In reality, the lack of operational experience makes the government ignore to fulfill the obligation of the government legal.At the same time,the government's has no limited rights and makes abuse of power, resulting in phenomenon:Emphasize the government power, ignore the obligation;Emphasize the control,ignore public participation;Emphasize the government power, ignore the obligation;Emphasize person's legal responsibility, ignore government's legal responsibility.Government has regulations in the constitutional and legal level,The constitution is the most fundamental law our country,which makes the government can't resist the responsibility. The change of the public demand in the legal theory, human rights,the unity of right and obligation and social justice theory show that the government takes the dominant environmental regulatory responsibilities,and clear the government legal responsibility for the central government and local government on the scope of legal responsibility.Therefore,the government should take up the responsibility, analyze the problems and reasons from administration, supervision and decision-making, at the same time analyze government legal responsibility for rural environment pollution in situation and form,and take the effective measures.It needs to make the correct performance of environmental protection concept,Strengthen the public participation, establish the government accountability and Environmental supervision system, establish reconstruct supervision system of vertical,take actions about criminals,etc. In addition,it's necessary to introduce the advanced management experience from developed countries such as U.S.A and Japan, and make supervision of the rural environment.Legally defined responsibilities of the government and make concrete measures in practice,to achieve better a rural environment, develop and maintain a good economic environment and create a good condition.
