Since the reform and opening up, Chinese economy and society develop, and people's living standards increase continuously. But economic development also damages to the environment, so China's environmental situation is very worrying. Although China has promulgated a number of environmental protection laws and regulations, China's legal system is not perfect. Soil Pollution Control Act has not been developed. Soil is the material basis on which human people live and development, it is an important part of the ecological environment. Soil environment affects not only China's economic development, but also our food security and people's health. Soil pollution has become an important factor for constraint in the harmonious development of economy, society and environment. Purpose of this paper is that develops the Soil Pollution Control Act, perfects the legal system for soil pollution prevention, and promotes the pace of China's legal community.This paper has a comprehensive understanding of soil pollution state and hazards on Chinese economic society development and human health. It comprehensively uses lots of research methods, such as analysis, examples and comparison, and learns the advanced experience of soil pollution control legislation. To draft the Soil Pollution Control Act. First of all, this law should follow the following main principles:the principle of maintaining the ecological security, the principle of sustainable use of soil resources, the principle of state intervention, the principle of polluter governance and national relief, the principle of public participation, the principle of soil pollution accountability and the principle of special protection to agricultural soil. these principles have played a vital role in the legislation; Second, it should have the legal systems for soil pollution prevention, such as:the system of soil environment standard, the system of soil pollution monitoring, the system of impact assessment on soil pollution, the system of information publicity on soil pollution, the system of emergency management on soil pollution, the system of deadline control on soil pollution, the system of pollution repair; Finally, strict liability effectively guarantee implement of "Soil Pollution Control Act".
