| Soil is one of the most important environmental factors to the survival of humans, and no one race can survive without soil since ancient times. For a long time, the soil pollution had been neglected by public due to its hysteresis. In recent years, many environmental pollution events and aggravated soil pollution have made us have no choice but to face the problem. In order to protect the soil pollution orderly and effectively and guarantee the safety of soil environment, the highest priority is to research and discuss the legislation of prevention and control of soil pollution in our country, and then perfect related legal system. This paper firstly defines the concept of soil and soil pollution etc, and then analyzes the characteristics and harm of soil pollution, which helps readers to better understand the urgency of the prevention and control of soil pollution. Secondly, this paper introduces the present situation of soil pollution in our country, and analyzed the forming mechanism of the current situation of soil pollution in China. Later, through empirical analysis, this paper summarizes the existing provisions on prevention and cure of soil pollution in China, including the constitution, laws, administrative regulations, department regulations and other normative documents, and sums up the defects and the insufficiency of legal system of protection of soil pollution in China. Finally, combined with the situation of soil pollution in China, the author puts forward some ideas of perfecting our country’s legal system of prevention and control of soil pollution, which is, before establishing the legal system of soil prevention and control, we have to clear the basic principles, then devide the soil into regions according to the function and control aim and establish the law of prevention and control of soil pollution and relevent regulations and rules, so as to perfect the specific management system, clear legal responsibility and strengthen the supervision and management work of soil pollution. In the end, a good legal system of prevention and control of soil pollution will be established. |
