Soil is the basis on which people live , and it is one of the most important resources of a nation. The quality of the soil not only directly affects the security of the agricultural production, food and human health, but also concerns the safety of national land resources and the sustainable development of economy and society. During the past few years, with the rapid development of national economy, the problem of soil pollution is becoming more and more serious. But , we do not attach importance to soil pollution like to air and water currently. The seriousness of the soil pollution reminds us that the protection of soil is of equal great importance to that of the air and water, etc. In order to reduce the degree of soil pollution, we must intensify the work of prevention and treatment of soil pollution, among which the most importance thing is to enact relevant laws and regulations. Up to now, there is no special law of the prevention and treatment of soil pollution in China. However, there is no specific laws and regulations about the prevention and management of soil pollution. As a result, the relevant work is not enough. In order to change such kind of situation, it is necessary to establish a long and steady legal system to guarantee the legalization and regulation of soil prevention and management.So it is urgent to prescribe a special law of the prevention and management of soil pollution.For the above purpose, the author begins with the present situation of China's soil pollution, combined with the reality of China and the characteristics and status of soil pollution, then studies the necessity of the legislation of the prevention and management of soil pollution. Then analyses the legislation of other countries and the legislative reflection for our countries. At the same time , the author analyzes and evaluates the legal system of prevention and management of soil pollution and then learns the advanced experiences and development trend from foreign countries and then suggests that it is necessary to improve the legal system of the prevention and management of soil pollution in our countury.
