With the development of marine and human society, the increase in utilization of marine activities, marine environment, a growing problem. Oil pollution which is particularly related products such as crude oil and its most serious marine pollution, marine oil is one of the major pollutants have on the marine and coastal environment of coastal States caused serious harm. And solve the problem of pollution of the marine environment by international treaties and only the individual laws of individual countries is not enough, you also need to establish a complete set of marine oil pollution prevention and control legal system.This article from the current material of marine pollution by the oil situation and the serious pollution prevention of marine oil pollution of the current legislative status of the defects or deficiencies in the talk, combined with and learn from various related international treaties and agreements and international law on the specific protection measures, as well as national legislation to prevent some of the advanced principles of law of marine oil pollution and measures to prevent marine oil pollution in China to perfect the legislation. Paper is divided into five parts. The first part is an introduction, the author of this paper is the subject of the background, purpose and significance of the study and research status at home and abroad and the main content of the instructions. The second part, the author related to marine oil pollution has defined the meaning of, and on this basis, the characteristics of ocean oil pollution, causes and hazards in-depth analysis. Although the initial formation of our current legal system for marine environmental protection, but there are still many problems and defects. Marine oil pollution since the lack of legal liability, legal measures and the legal system is imperfect and other issues not directly affect the integrity of our marine environment and related laws and regulations can be implemented. The paper mainly analyzes the development of the United Nations and other international organizations, international treaties or agreements, and the United States, Britain, Japan and other countries related to the prevention and control of marine oil legal and regulatory conditions, analysis of these different modes of legal and management system for the international treaties or agreements and national laws of the advantages and disadvantages of foreign experience for reference, starting from a system of legal norms, improve the prevention and control of marine oil pollution laws and regulations and systems to protect the marine environment and safeguard China's maritime rights and interests.
