Research On Legal Issues Of Water Pollution Prevention And Control In Shanxi Province

Water pollution means that when rivers,groundwater,lakes and other water bodies are invaded by pollutants,the content of pollutants exceeds the purification capacity of the water body itself,thus affecting the water quality and the chemical and physical properties of the water body,it reduces the use function and use value of water,which has the characteristics of complexity,difference,sociality and so on.The prevention and control of water pollution is to prevent and control the phenomenon of water pollution in order to improve water quality and beautify the environment.Water pollution means that when rivers,groundwater,lakes and other water bodies are invaded by pollutants,the content of pollutants exceeds the purification capacity of the water body itself,thus affecting the water quality and the chemical and physical properties of the water body,it reduces the use function and use value of water,which has the characteristics of complexity,difference,sociality and so on.The prevention and control of water pollution is to prevent and control the phenomenon of water pollution in order to improve water quality and beautify the environment.Shanxi Province is an extremely water deficient Province,and has formed a heavy industry pattern relying on the advantages of coal resources for a long time.Most of the projects with high energy consumption and heavy pollution are still in serious pollution situation,and the task of water pollution prevention and control is heavy.Based on the legal problems existing in the prevention and control of water pollution in Shanxi Province,this paper analyzes and proves from four aspects: the setting of legislative purpose,the choice of responsibility subject,the application of repair measures and the implementation of safeguard mechanism.First of all,the legislative purpose is the soul of a law.The accurate setting of the legislative purpose will play an important role in the scientific formulation,correct understanding and effective implementation of laws and regulations.This paper argues that we should abandon the idea ofeconomic development at the cost of waste of resources,and take promoting the restoration and protection of water resources as the core value goal of legislation,instead of letting it bear the economic and social functions that it does not belong to.Secondly,the choice of subject plays an important role in the realization of legislative purpose and the implementation of law,which has always been concerned by legislators.This paper holds that the characteristics of water pollution prevention and control determine that it should present the diversification of responsibility subjects,and gradually form a new mechanism of water pollution prevention and control which is led by the government,managed by enterprises and participated by the public.Thirdly,the selection of restoration measures plays an important role in the prevention and control of water pollution.This paper suggests that in the selection of restoration measures,we should fully respect the operation law of the ecosystem,adhere to the basic policy of natural restoration as the main and artificial restoration as the auxiliary,put the use of natural forces to restore the water ecosystem in the first place,and also clarify the specific flow of ecological water transfer,and gradually restore the river's self capacity.Finally,the guarantee mechanism of water pollution prevention and control provides strong support for the work of water pollution prevention and control.This paper believes that we should constantly improve the fund-raising mechanism,give full play to the role of private capital in water pollution prevention and control,stabilize the government's financial expenditure,increase the proportion of water pollution prevention and control in financial expenditure,and at the same time,we should implement the administrative accountability system to achieve true accountability and dare to accountability And effectively improve the level of water pollution prevention and control.
