The Link Up Training And Examination Mechanism Of Vehicle Drivers

China has developed quickly since the reformation and opening policy implemented. The life of people changed dramatically, more and more people choose to drive their private car for outdoor travel. In that circumstance, the applications for the drivers'license increased and more driving schools set up. The above changes add pressure to the regulator in respect of training of drivers and the test management, and problems like unfair competition, low quality of training and bribing for test were revealed. The author believes those problems are mainly caused by the defect of mechanism regarding the drivers'training and test management.Firstly, the thesis briefs the arguments regarding the drivers'training and test management and clarifies the concepts and regulations. The paper reviews the 60 years history of drivers'training and test management since the establishment of new China. While acknowledge the achievements, the paper dresses the issues need to be deal with currently, and point out that the solution is to build up an mechanism which will connect the drivers'training and the test management. The paper also gives analysis on the effects of the mechanism to the compliance of operation of the driving school, the execution of regulation, the safety of traffic and improvement of service.Secondly, the paper addresses the following problems based on the practice:A. Issues in legal aspects: 1. No detailed rule is stipulated in the Law of Road Traffic Safety regarding the linkage of drivers'training and test;2. The specific effect the driver license test caused to the public safety is not reflected in the Administrative License Law;3. The level of law is conflict between the training and test;4. Implicit conflicts exists in the Law of Road Traffic Safety and the Administrative License Law;5. The effectiveness and range covered by some of the regulations are limited.B. Issues in rules:1. Irrational rules and procedures in the rules respect to drivers'test;2. Defects exists in respect the regulation for driving school and instructor, record of training, assessment of training quality, entrance approval, the weed out system.C. Link up of mechanism:1. Defects on the cooperation between departments;2. Lack of coordination and supervision in the mechanism;3. Lack of application of intelligent and scientific management;4. Lagged simple service.Finally, the proposals are addressed in the paper for improving the linkage in the mechanism of training and test management, in the respects of compliance in administration, reform of the training and test application, scientific management of training industry, optimization of training and test procedures and establishment of development plan.The creative points in this thesis including:1. Suggestions to revise the Law of Road Traffic Safety and the Administrative License Law, make it a legal requirement that the training is one of the preconditions for application of driving license, in the aim to add up legal validity for the linkage of the training and test.2. Mark up the inconformity between the format of training record and the Training Guideline for Vehicle Drivers, and provide suggestions for amendment.3. Name the defects in the procedure of the training and test, and suggests the test should be arranged after all the training completed according to the Guidelines.
