Research On Legal Protection Of China's Energy Security

Energy is not only the basic support of national economy,but also the basis of human survival.The strategy of energy security is a strategic work for China, it exerts a direct influence on national security, sustainable development and social stability, is an important aspect of national economic security.In order to ensure the strategy of energy security,it is a primary measure to establish and improve the energy legal system. Furthermore,it is a fundamental means for the various countries to promote energy security.In recent years,not only China's energy legislation has been strengthened and China's legal system of energy security has been preliminarily formed,but also has played the positive role in the practice of China's energy activity management.But there are still many insufficiencies in China's legal system of energy security, therefore,it has become a top priority to establish and perfect China's legal system of energy security.Energy security is a problem in most of the countries in the world,many countries have done useful trials in aspect of how to solve the energy security problem through the legislation.The legal system of western developed country is prior developed,they promoted the development of energy at the same time made some mature legislative achievements,and many experiences are worth using for reference.The construction of China's characteristic socialism legal system of energy security,not only must learn from advanced foreign experience and the results of energy law,but also need establish legal system and legal regime of energy security conforms to China's national conditions.It is a combination of energy supply security and energy utilization security.The former one is a basic goal of national energy security as well as a concept of quantity and the latter one is a much higher objective of national energy security and a concept of quality.China should make great efforts in its legal protection of energy security from three aspects: Firstly,strengthening energy supply security legislations including legislations of energy reserve.Secondly,focusing on the importance of energy utilization security legislations including legislation of improving energy efficiency,energy saving and legislation of reinforcing new recycling energy's exploitation,utilization and extension.Thirdly,strengthening the international cooperation of energy security.Only by carrying out these measures,can China achieve sustainable development in its way of exploitation and utilization of energy resources.
