The Law Study Of Water Resources Management

This article has five parts. The first part is the introductory part, the author of this article firstly describe the contents in general, including the foundation of the item selection, and the significance of the article, the innovation points and weaknesses of the article. In the second part, the author gives us the meanings of water resources, she defines it from various angles , on this basis, the author analyzes our current water problems. In China, the situation and major issues of water resources are: inadequate of water resources, waste, water pollution, water ecosystem destruction, over-exploitation of underground water, wastewater treatment technologies are lower , and so on. In view of water problems, the author analyzes the causes of the problems of water resources, and the reasons contain six aspects which can be summed up as follows: the irrational structure of water resources, water resources management system has the macro-defects, the lack of property rights system, unreasonable water pricing system, saving water system and waste water management measures are in displace, protection laws and regulations of water resources are not sound. In the third part the author describes the situation of water resources management from a legal point of view, "Water Law" is the fundamental law of our country's water resources management, from the covering contents of "Water Law" to describe water resource management task, but the current laws in our country have the deficiencies in sound legal system and the implementation of law, lacking the legal system and displacing water resources management make the final legal support scarcity, which is an important reason that leading to poor management of water resources. The fourth part of this article involves foreign water resources management legislation, an analysis of different models of the management of foreign status of legislation, these experiences could provide some reference for our water resource management legislation. The last part of the article the author put forward three proposals based on China's current water resource management issues: the first proposal is in the macro-management system, to coordinate the interests of different sectorsto establish a unified management system, from a macro Level to handle the deficiencies in water resources management; followed by the response to the shortage of water resources, water resources management itself should be improved, the rational management of water resources, water conservation, water management measures are all important aspects of the management of water resources; finally from a legal point of view to improve Water resources management, which is the focus of this article, from seven major aspects to discuss, including the security of administration's legal status and functions, law enforcement issues, improving the supporting laws and regulations, Mechanisms of citizens' law awareness and participation, the establishment of water markets and improvement of the justice mechanisms.From the above-mentioned proposed legislation of water resources management, in order to cope with the shortage of water resources in China , the author seeks to establish an efficient and comprehensive water resources management system, to promote the development of the national economy and heighten people's living standards.
