The Study Of Rawls' Procedural Justice

The ideological origin of justice has been long. People have never stopped their steps of pursuing justice for thousands of years. Rawls was a well-known American political and moral philosopher. He wrote a series of highly influential articles, including"A Theory of Justice","Political Liberalism"and so on. His thought plays an irreplaceable role in contemporary Western trend of thought. Awls actively promoted the values based on justice which was the main content and object of his theory. Procedural justice is considered as a very important part of justice. In"A Theory of Justice", John Rawls proposed a detailed conception of justice as well as the division of procedural justice. He divided procedural justice into three types, which are the perfect procedural justice, imperfect and pure procedural justice. And thus he presented as the theory of value about procedural standard. Based on the research results which are already made in academia, this article studies Pawls'procedural justice as a complete system of thought and attempts to give it a reasonable fixed position under the law .This article shows the feasibility of Rawls'procedural justice theory in China, besides the existing problems and rational solutions. The core subject is divided into three parts. The first part of them is about the definition, which, among them, will give a clear concept of justice and the meaning of procedural justice. In the second part about the Rolls theory of procedural justice, the author particularly explores the thought of procedural justice, and extends Rawls procedural justice value of thought .In the last chapter, the author discusses the relationship between Rolls procedural justice and Chinese legal system construction through the combination of the four parts. The first part is of the status and cause of the procedural justice in China's development, the second part is of possible way to develop the Rolls theory of procedural justice, the third part is Rawls justice theory'construction to our program of legal system and the final part is to perfect the procedural justice, trying to explore the development of the procedural justice in China.
