Base on the data of Hubei Province Archives, combined with field survey, by using the methods of empirical research and long-time research, through case analysis, this paper analyses the three times property disputes of XieJingSi temple in Yidu country from 1930 to 1948, in which showed the gambling process of how the Government, the squire and the monk used various resources to obtain benefit.This paper is divided into four chapters. The first chapter elaborates the profile of XieJingSi Temple, including its origin, nature, temple property& operating status, and its member. The second chapter describes the first property dispute of XieJingSi Temple from 1930 to 1934. By analyzing the internal strife of XieJingSi Temple, the litigation between monk and Yidu local government, the complex process of decision which was made by HuBei provincial government, we can find that modern Buddhism was in crisis and to achieve the renascence, the legal system and jurisdiction of the Republic of China was in a transitional stage. The third chapter describes the second property dispute of XieJingSi Temple. By analyzing the process of monk protesting Yidu local government and squire, the litigation between monks and the HuBei provincial government, we can find the reason that the monk lost the lawsuit is mainly because the central government defaulted on the local government's illegal behavior of encroach on temple property since the Government needs a huge sum of money to resist against Japan. The fourth chapter elaborates the monk'effort to request for reimbursement after the victory of Sino-Japanese. In the last part, the paper summarizes the reason of the XieJingSi Temple property dispute happened. And the reason is the result of combined effect of the Buddhism internal factors and the macro-environment. The difference policy of central government and local government comes from its field of view. The practice of the monk successful used law to safeguard their own interests is a microcosm of modern Buddhism adapting itself to the modern society.Overall, the property disputes of XieJingSi Temple reflect the relationship between the monk and layman, officials and civilians of up-country districts in a complex and inconstant era. To some extent, this study is propitious to enrich the disputes academic circle's experimental comprehension to temple property disputes. Through the paper we can thoroughly understand the phenomena and the reasons in which hiding in the process of confiscating temple property to set up schools. The paper is supposed to offer some constructive comments to correctly evaluate the study of confiscating temple property to set up schools, investigate deeply the paradigms of Chinese nation, religion and society unite which studied by today's academic circle.
