The Reaserch About Huang Gan's Thoughts Of Politics And Law And His Practise

This thesis discusses the thoughts of politics and law of famous neo-confucianism called Huang Gan who lived in the Southern Song Dynasty. For the purpose of showing its journey comprehensively, the author synthetical narrates the careers of Huang Gan firstly.With the overviewing of Huang Gan's family background for starting point,the author not only interpretates the relationship of Huang Gan and Zhu Xi, as well as remarks his political experience and his late years. Then we can have a preliminaryly understanding on the formation of his main thoughts. It also helps to below play and forensics.Huang Gan's political activity is the main content of this paper. Though lived in the middle-Southern Song Dynasty which encountered complex political environment, Huang Gan never shrinked back. He kept improving the people's livelihood and enhancing national strength as his basic in office. Starting from the action of reliefing survivors, and moreover, he had the behavior on reforming old system to spare people's burden. When affronting the invasion of late JinGuo, Huang Gan claimed to enterprise to save his home positely. At the same time, in order to strengthen the border construction, Huang Gan did lots of effort that showed the spirit of bloody righteously and fearless death .As a neo-confucianism and a Southern Song courtier, Huang Gan contributed his all strength for rescuing the country and people.As the inheritor of Zhu Xi's theory, Huang Gan succeed the descendant of traditional confucian's legal philosophy, when he adjudicated cases, he always mixed natural-principles and law as the foremost position. Meanwhile, Huang Gan breakthrough and innovate the traditional legal concepts for his flexible life-philosophy. Moreover, In the adjudication of cases, Huang Gan fused his rigorous personality which can restore the truth and formed a meticulous trial style.In the special historical periods and complex social environment, for securing the interests of ordinary people, Huang Gan quashed the illegal despot esolutely and punished the scholar-bureaucrats strengthenly, which played a positive role in promoting social stability and harmony and constructing the social order that Confucianism advocated.This article will employ narrative method, example method and the apagoge to study and discuss. Using plain language to show Huang Gan's extraordinary life that can fully reflected his thoughts and ambition on serving our country and concerning the livelihood of the people .At the end we can have a new research on the historical position of Huang Gan as a famous Confucianism.
