Sociologial Analysis Of The Institution Of Property Rights

The institution of property rights is systematical arrangement of property rights relationship and a series of regulations of distinguishing~defining~ protecting and performing property rights. Author believed that the institution of property rights are not only a economic norm, but also a social phenomenon; the institution of property rights restrains the economic action and normalize the economic order, meanwhile interacts each aspects of the society.This paper divided into five chapters. Firstly, author simply summarize the three basic concept: property rights~ transaction costs~. the institution of property rights in the economics of property rights and briefly introduce some achievement that scholars in foreign and home achieved in the fields of the economics of property rights. Author analyses the social stratum and its characteristics on the condition of the institution of public and private property rights, author also compare the difference between them. on the basis, author positively analyses the changes of the institution of property rights in china have brought effects on social stratum after reform-opening. About the relationship between the institution of property rights and social changes, the institution of property rights deters or promotes the social changes by the way of influencing on the social activity~ institution and productivity. Society development is a main form of social changes, author believe that the changes of the institution of property rights promote the mankind's freedom~ liberation, equality and society sustainable development, the erection of the institution of intellectual property rights protection greatly promoted society development. Social stability demand that the institution of property rights possess continuity., impartiality and protected by laws. A good social order is the main form of expression of social stability, the institution of property rights and social order are interdependent, the institution of property rights provide the basis for the social order, at the same time, expression of the powers and functions of the institution of property rights also demand support of social order. The shortcoming of property rights is a sort of general phenomenon in developing country, it is also serious threat power to social stability. Chinese society is in the period of transformation from traditional society to modern one. After 1980, reformation of the institution of property rights greatly promoted the transformation of Chinese society. Author believed that the stable progress of transformation of the china society must strengthen and perfect construction of the institution of property rights.
