The economic take-off after the Reform and Opening-up has provided an economic foundation for the emergence of new social stratum in China.The strength of the individual economy,private economy and foreign capital economy has steadily increased,which promotes the rising of the new social stratum.According to the statistics,the number of new social stratum in China has reached over70 million,and they have become the backbone of the middle class in China.They play an indispensable role in expanding employment,developing the economy,promoting social harmony,forming a healthy olive-shaped social structure,and overcoming the middle-income trap.In February 2007,through the recommendation of the Ministry of Construction,the Chinese Society of Real Estate Appraisers and Real Estate Agents became a member of the new social stratum.Real estate appraisal and real estate brokerage industry practitioners have officially become an important part of the new social class ever since.In this context,it is of great significance to study the protection of labor rights and interests of this group.This research focuses on the protection of labor rights,interests of real estate agents,taking intermediary organizations and employees of social organizations,which are the four major components of the new social stratum,as the research object.In this research,Maslow’s hierarchy of needs theory,dual factor theory,ERG theory,literature research methods,survey research methods,and in-depth interview methods are applied to conduct multi-level and multi-angle investigations and researches on the protection of labor rights and interests of real estate agents.In terms of the labor rights and interests protection,real estate agents are facing problems: low labor contract signing rate,insufficient labor remuneration,unreasonable salary structure,high labor intensity,the lack of rest and vacation,on-the-job training,and insufficient social insurance coverage.The reasons for these problems are multifaceted,such as weak legal awareness among workers,high cost of safeguarding rights,low level of human resource management by enterprises themselves,business operators who focus solely on their own interests and ignore the rights and interests of workers,weak labor security supervision,inadequate legal publicity,and narrow coverage of non-public enterprise trade union organizations.Therefore,real estate agents should enhance their awareness of legal rights,consciously safeguard their legitimate rights and interests,improve their comprehensive quality,and enhance their bargaining power in the employment market.Enterprises should pay attention to the construction of their own human resource management level to deeply meet the multi-level needs of practitioners,strengthen the publicity of labor laws and other relevant laws,strengthen labor and social security supervision.The competent departments of the real estate market industry should actively implement regulatory responsibilities and improve the coverage of trade unions in non-public enterprises.Thereby the level of labor rights protection can be comprehensively improved.
