On Moral Environment Of Governing The State By Law

To build up socialist legal system and to administer the county by laws have become the common concern of our Party and the whole nation. The democratic system of government, the division and restriction of rights, the market economy system and rational culture are all our aims. According to Marxism, everything is in a unity of opposites, and its existence and development is definitely affected by other factors. There fore, there is no exception to the strategy of rule by laws. This strategy is also affected by social economy, politics, culture and moral environment. Among all these factors, economy plays the decisive role and morality directly influences rule by laws: good moral environment is one of the most important factors to rule by laws. By modernization construction and practice of rule by laws, our Party puts forward the strategy that our country is ruled by laws and morality. And this strategy has solved the problem that rule by law has been long detached from rule by morality.This thesis deals with the relationship between laws and morality, between rule by laws and rule by morality, the influence of moral environment on rule by laws and the perfection of moral environment. Specifically, it includes five parts. In Part I, the author tells the great significance and necessity of choosing this topic and presents the method of studying the subject. In Part II, he discusses the relationship between laws and morality, rule by laws and by morality. Laws come from morality and the code of morality is fixed by laws. Rule by laws and rule by morality belong to two different categories, but they affect each other. The third part deals with the constitution of key element of moral environment and its effect on laws. The moral environment discussed in this paper refers to all moral factorsiii-MASTER'S THESISand conditions that will affect rule by law. It includes moral consciousness, moral subject, moral tradition, moral culture, etc. In Part Four, the author puts forward the measures of strengthening socialist moral construction, of creating good moral environment and of speeding the steps of ruling the country by laws. Part Five is the conclusion.In a word, this paper deals with the relationship between moral environment and rule by laws and the former's effect on the latter, and presents the measures of improving moral environment to realize the socialist rule by laws as soon as possible. It has great realistic significance.
