Goverment Administration By Law Under Market Economy

How to handle the relation between government and market and how to get the relation into the rail of legal system under market economy has become an important issue of theory and practice in the strategy of market economy system and legally ruled nation. Regarding the relation between government interference and the development of market economy, the most important issue is how government interferes and how to promote the establishment and perfection of market economy system. Either under complete market economy system of the west or during the construction of China's characterized socialist market economy system, should government, the "unseen hand", play its important rule? What's the principle based on which government plays its rule by law? What ways should be adopted to interfere? And so on. This thesis attempts to discuss above issues.This thesis consists of 4 chapters and the conclusion, totaling 5 parts.Chapter 1 "General Survey". The author gives brief statement on issues encountered under market economy, especially under the construction of socialist market economy with Chinese characteristics, meanwhile focuses on the contents of how our government administrates market economy by law.Chapter 2 "Meaning of Government Administration by Law" briefly states the types and the principles of government administration by law.Chapter 3 "Necessity of Government Administration by Law" first analyzes the ideas and principles of market economy and proposes that the ideas and principles of market economy must be legalized, with which theconclusion of " The substance of market economy is legally ruled economy". Based on this, it is proposed that legal basis of the government administration by law is market and its behavior law, macro-control law, social labor and insurance law and so on.Chapter 4 Emphasis of the thesis is " Ways of Government Administration over Market by Law". In this part, the author has proposed suppositions regarding ways of government interference and made related analysis. Aiming at imminent issues regarding market itself, its behavior and supervision, the author believes it is a must to clarify the establishment of law, standardize administration behavior, enhance legal supervision over legal administration, smooth the system of market supervision and strengthen the force of legal administration.The conclusion raises the malfunction of government that often occurs while it makes wrong interference and briefly analyzes the reason and summarizes that healthy market economy development can be ensured only when government interest relation is smoothed based on legal system and government interference is standardized by rules and laws.
