A Study Of Ethical Progress Promoted By Rule Of Law

Rule of law takes roots in people's political ideals and pursuits,and it has been crowned with constitutional position in democratic countries.As a strategy of running the country,rule of law plays an increasingly important role in managing the state affairs in China.However,only when ethical progress cooperates with rule of law,the implementation of the strategy can be effective.Rule of law doesn't always march in step with ethics or ethical progress.Rule of law presupposes the rule of good laws.This article comprehensively analysed the appraisal criterions of good laws and then pointed out that the sound mutual promotion between rule of law and ethical progress,which is the prerequisite of ethical development promoted by rule of law,is carried out in the areas of ideology,norms and organization.The legislative practice in ancient or modern times and in china or elsewhere promoted and is promoting ethical progress by turning some moral rules into legal norms.It is obvious that the lawembodies a moral code,and does so explicitly.The law books of many countries make this point in the most elementary way.Murder.theft,rape and income tax fraud are immoral and illegal as well.Implementation of law ,which embraces three aspects,law enforcement,law-abidingness and judicature,is the main way of ethical progress promoted by rule of law.This article studied the roles of ethical justice of law enforcement and. ethical mission of law-abidingness and ethical guarantee of judicature.Precisely because of just law enforcement and strict law-abidingness and fair judicature,the moral principles and moral sense and moral duties,mixing together with legal norms,can strike root in the hearts of the people,thus impelling the people to do their duties.
