The China's land is owned by the public (a political concept: the people) under socialism system, which is divided into the two different ownships system, one is the state-owned, the other is the collective-owned. All of the land belongs to the state as that one in urban or to the collective as that one in villages and suburb but for the special regulation.It is only but one legal way to convert the collective-owned to the state-owned by requisition the former as a complement to the urban land in the continuous converting since China built the land-public-ownship.However, there are more and more problems that come along the unfit between the institution of taking over and the developing market economy this day. This paper expatiates the malpractice that exists through comparing with the other institutions of taking over land, such as broader bound, narrower scope for compensation, littler standard on compensation, nonlucency progress, incomplete safeguard by law and code and kickback for such above factors, then it analyzes the causes for them. And it draws a conclusion that it is unfit for changing economics system and social conditions greatly of the old institutions fallowed from planning economics.Considering the equity to the efficiency in the progress of converting the collective land into the state, I think we should complete the institutions to remedy failure in market, and consummate, the market economy to remedy failure in government on the base of property right.It parties the public behalf on land into pure one, quasi one and none on the base of obvious productivity, and it would solve the need for the former two bytaking over, and the later through market.China has made experience of the institutions reformation on land requisition in nine cities over five provinces. It has started but it has difficulty in converting collective land to state land through market of the reform of land requisition this day just lack of a whole institutions needed to hold up. Finally, the paper gives some beneficial imaginations on institutions of converting collective land to state land through market. I think it is meaningful because such institutions devising can enlarge social welfare matching the behalf of the country and the people, and it is a necessary ways and tendency for converting collective land to state land.
