Study On The Supervision Of Business Administration Institution On The Electronic Commerce Under The Present Laws And Regulations

With the development of the computer and network technology in recent years, network economy led by electronic commerce gradually becomes the liveliest economic form. However, this new way of commerce in the growth of itself needs to be studied and regulated as it has set challenge to our conventional laws or administration system. It is a new right entitled to Business Administration Institution by the government to have supervision on the network economy such as electronic commerce. Thus, it's of both theoretic and practical significance to enlarge supervision fields for Business Administration Institution in Chongqing and to ensure the actual implements of its functions and powers by study on the measures it takes to supervise the electronic commerce under the current laws and regulations. This paper introduces in the first place the current growth of electronic commerce, its conception, categories and functions, with particular importance being put on the analysis of the differences and advantages between electronic commerce and traditional trade. Meanwhile, problems and deficiencies in the laws about electronic commerce have been identified through study on the legislations of various countries and international organizations. Four critical problems(law effects of electronic contract, electronic signature and certification, protection of intellectual property and costumers' interests ) that influences the healthy development of electronic commerce are taken as the base, above which detailed discussions have been done on the differences between the developed western countries and us in handling problems in those four aspects, so as to point out the difficulties and problems that Business Administration Institution confronts in their supervision on the electronic commerce. After analysis of the present growth environment of electronic commerce in Chongqing, this paper proposes three problems that need to be resolved in their supervision, in addition to the three principles to its administration, namely regulation of orders, protection of rights and promotion of development, followed by four practical supervision measures suitable for the business administration institution of Chongqing to put into operation in the present situation, which are format of contracts in electronic commerce, enforcement of the administration in network advertisement, establishment of costumer right protection network and investigation or punishment of unrighteouscompetition. Finally this paper raises a long term plan to establish the certification management system of network business licenses with analysis on the advantages and possibilities for business administration institutions to set up a certification center, and suggests establishing a network consultant system of enterprises as a temporary measure to realize the long term plan.
