Online Electronic Certification Law

With the development of Internet technology, online transaction volume in China was the trend of rapid growth year after year, online trading has become an important driving force for China's economic development. Online trading is different from the real deal, not only in the special environment and the networking, but also reflected in the virtual nature of the subject. Transaction information and the authenticity of the security during the transmission problem are hindering the development of online transactions. The law adjust the traditional market has brought tremendous challenges. Therefore, use electronic authentication to confirm the parties related information, to confirm the validity of electronic contracts and clear main responsibility to ensure online transaction security is especially important.This paper is divided into five parts.The first part overviews the relevant issues, introduces the development status of China's online transactions, discusses electronic contracts and electronic signatures relations and on-line trading system of electronic authentication, and paves the way for the following analysis.The second part clears the relationship between certification authority, holder of electronic certification and trustee of electronic certification., analyzes the object, the rights and obligations between the parties.The third part introduces the international legislation and the implementation of electronic authentication, summarizes the development of electronic authentication features and mode of legislation to provide a theoretical reference system to build Chinese characteristics of online transactions and electronic authentication system.The fourth part focuses on the central and local legislation in China. The existing problems need to perfect from legislation and the environmental of implementation.The fifth part is the focus and innovation of this paper. Based on the analysis of the status of legislation and implementation, the paper from two angles makes to improve implementation of environmental legislation and recommendations, look forward to establish a Chinese online trading electronic certification legal system.
