| Although study on law of the network is focus at present, the study about civil law of online game is still a blank. Online game is regarded as a fictitious mutual game way, the fictitious society of the human communication, a new-type postmodern culture and a successful mode of cybereconomy. The uniqueness determine that game-player's behavior have individual and social to unify and the unified characteristics of consumer and producer, thus player rights should personality right and proprietary right, the rights and interests of consumer and producer organic to unify. This duality has caused the complexity of the legal protection method. Through discussion the personality right of game ID, the tangible thing nature of game article and player's ownership, the personality right and proprietary right of player are defined; the legal relation of contract between player and operator, the tort of the operator is analysed, and the suggestions about the mechanism of legal protection of player's rights and interests are put forward in this text, too.
