Following the sustainable increase of population and the high-speed economic development, the traditional distribution system of water resources can not meet the day-by-day increasing water demand. There are many problems with the currently-used water management mechanism and the rule that the water is allocated based on the governmental orders being out of control, being weighted against optimization of water resources using. By means of developing water market and adopting water right trade to re-dispose water resource, is one of the most efficient ways to alleviate the problem of water shortage. In this paper, the author firstly demonstrates the need and feasibility of the water market under the formal effectiveness of the new Water Law after the theoretic analyses on water market from economics and law aspect. And then the author compares with and use for reference to the mature experiences of three countries. Lastly, the author begins to construct the water market from main body system, behavior system and law responsibility system.
