The Integration Of Administrative Power--A Study On Integrated Law Enforcement Organization In China

Chinese integrated law enforcement organization is a legallyindependent administrative organization which exercises authoritiesof some interrelated administrative organizations through theintegration of administrative power for the sake of solving thehorizontal conflict of administrative power and the vertical problemof administrative efficiency in the field of the administrativeenforcement legal system. This dissertation makes a study on theinterrelated issues of Chinese integrated law enforcementorganization, which is significant in practice but insufficient intheory. This dissertation consists of the foreword, main text andconclusion. The main text has three chapters. The foreword gives a brief explanation about the intentions of thewriting and main issues that are going to discuss. The first chapter mainly confirms the conception of the integratedlaw enforcement organization , by introducing the evolution andanalyzing the types. First, after the four evolution phrases, till now, theorganization plays an important role in the administrative enforcementlegal system. Then, by comparing with other familiar conceptions, thefundamental meaning of the discussed topic is cleared. Using thestandard of normative and abnormal, the dissertation analyzed thedifferent types of integrated law enforcement organizations in China.It is emphasized that normative and legitimate integrated lawenforcement organization should be an absolute independentadministrative organization. The second chapter is an analysis of the role and function ofintegrated law enforcement organization in the administrative legalenforcement legal system. First of all, this chapter discusses thethesis of the reasons to establish integrated law enforcementorganization. Through stating the anxious need in practice and theinnovative break in theory, the establishment of integrated lawenforcement organization is proved to be of great importance inchina's innovation of administrative law enforcement. Subsequently,this chapter has a comparative analysis of administrative penaltybodies in foreign countries and the relationship between integratedlaw enforcement organization and other organizations. It points outthat the integrated law enforcement organization has an importantfunction in administrative law enforcement activity as one of theadministrative penalty body in China. Other organizations shouldcooperate with integrated law enforcement organization to found amutual active law enforcement system. The third chapter is about the trend of the development ofintegrated law enforcement organization. This chapter is dividedinto two parts. First, it illustrates the spread of the administerfield, the development of the vertical manage pattern and theestablishment of relatively centralizing on the power to imposeadministrative admissions, which shows the continual development andgreat impact of integrated law enforcement system. With the matureof the integrated law enforcement system, the integrated lawenforcement organization will appear in more domains and play greaterfunction. The second part discusses how to perfect integrated lawenforcement organization by administrative organization law. The conclusion part makes a simple summarization.
