After China enter the WTO, the competitive of our enterprises would not only come from domestic market, but also much more competitive would be in foreign market. Except the competitive of trade in foreign market, the competitive of Intellectual Property Rights (IPR) and technique will also much more and more important. One enterprise that owns more Intellectual Property Rights and technique would obtain more sharing of market. How about China in the battle of the competitive of Intellectual Property Rights? How should we face the battle without fire? We have not been put more attention on the Intellectual Property Rights of Patent and trademark for loge time. We always pay an attention to obtain achievement and ignore Patent. To estimate the success of an enterprise and a person is mainly whether the enterprise and the person has achievement, not Patent. The deviation of this recognition causes that enterprises have much more achievements, and less Patent and the losses of technique are severe. Thereby, we should not ignore the status of the Independent Intellectual Property Rights. The paper makes a research and finds the problems existing in the field of the Independent Intellectual Property Rights, put forward the countermeasures in macroeconomic and microeconomic ways through comparing between relevant regulations of WTO and current law of the Independent Intellectual Property Rights, and analyzing the status and its reason.
