On The Confess Institution

In Civil litigation, confess institution means one party admits the fact which another party advocates, thus brings out respectable legal effect. As a kind of means of judging the facts in civil case, confess institution fits the basic characteristics of equal nature and personal domain of civil procedure. It can either satisfy the judges' needs in recognizing the case facts or save the lawsuit cost. It can also improve the procedure efficiency as well.As a very important institution in civil litigation, many countries, either common law system or civil law system, have detailed regulations and matured theory research on confess institution.In consideration, the current civil litigation system in China has a poor regulation and lacks basic theory research. Through a comparative study, this article illustrates the concept, character, basic theory, subject, object, classification and efficiency of confess institution. Based on this foundation, this article gives some suggestions of the confess system of china, aiming at constructing a sound system in the future.
