We called the current advanced age as "Information Age". It is characterized by thelarge-scale use of the computer system. At the same time, we frequyently meet the"piracy software" problem. The goal of this thesis is to have a thorough analysis of thisproblem and give our practical countermeasures. The preface of this paper is to talk about the reason I choose the "piracy problem"as my topic. There are two kinds of reasons: one is Macro-level such as the influence ofWTO; the other is Micro-level such as my personal experience of installing thesoftware on my own computer. The second part is the beginning of the whole body. First, I introduced thedefinition of the software and its characters. Secondly, I told the definition of "piracy"and its type and characters. As we all know, we met "piracy problem" several yearsearlier, we talked about the research achievements of the study of "piracy problem"including legal, economics and sociological aspects. Because of the failure to have anall-round study, we need two new methods: one is law and economics, the other is lawand sociology. The third Chapter is law and economic analysis of the "piracy problem". There aretwo main tasks: one is to analyze the "price gap" between the authorized software andthe piracy software. As we all know, the "price gap" is closely related to piracy problem.The other is to analyze whether the legal rule to piracy is effective or not. We can seethat as the missing part of "compensation obligation" and "duty of care" ,we are noteffective to punish all those people who are engaged in "piracy software industry".The fourth part is the law and sociology analysis of "piracy problem". As we put"piracy software" into the background of the whole society, we can see the influencesto all aspects of our lives such as "freedom and dependence", social structure, socialorder and relative legal power and social choice. We talked about this problem in thesedifferent ways. The last chapter is the legal countermeasures base on the analysis of law andeconomics and law and sociology. I hope to improve our legal system to solve the"piracy problem" in the nearest future. There are several ways in this paper: 1 Positive method. During this period, I haveinterviews with relative government offices and analyze the research data in this paper.2 Comparative method. I introduced other advanced countries' experience in thisthesis.
