The system of Administrative Examination and Approval (AEA) is a new subject in the theoretical study of Politics and Administrative Management (AM). At present, most of the AEA studies remain at the experience level, and a thorough, in-depth and systematic research is rarely seen. Therefore, to enhance the analysis and study of this subject is of great value both theoretically and practically, especially for improving the reform of AEA system, for speeding up the AM reform and management method innovation, for advancing the process of law-governed administration, and for perfecting and developing China's Socialistic market economy. This paper, based on the theory of Politics and Public Administration and some other research results of the earlier generations, employs the systematic method and some other methodology to study carefully and objectively the development of China's AEA system and the historical inevitability of the AEA reform under the present economic situation. And it further points out the problems existing in AEA system and some key elements in deepening AEA reform. Then, a few suggestions are brought forward. This paper is roughly made up of five parts: Chapter One Definition and Characteristic of AEA. This part analyzes the basic properties of AEA and the AEA in terms of law, that is, the concept of Administrative Approval. Besides, it clarifies AEA characteristics: 1. The exclusiveness of AEA subject; 2. The passivity of AEA action. 3. The finiteness of AEA content; 4. The ban-lifting feature of the approved matters. Furthermore, from the points of view of AEA originating logic and its value orientation, four aspects of AEA functions and roles are concluded: namely, to allocate reasonably the resources; to protect the public interests; to maintain the public order; and to control the economic risks. Chapter Two The Evolution of China's AEA system. According to the different functions and different degrees of influence of AEA under different economic systems, China's AEA can be divided into 3 stages: Stage One Formation. In the period from the founding of China to the 3rd Plenary Session of the 11th Central Committee of the C.P.C., AEA, as a basic means for the government to control the society, is widely used, but it concerns only a few fields and its legal conditionality is limited. Stage Two Development and Expansion. Within the 20 years from 1978 to 1998, as a relatively independent and important means of AM, AEA has gradually entered into nearly every field of the economy, society and life. Stage Three Uprising Reform of AEA. The issuing of Administrative Approval Law in August 2003 embodies the latest progress of China's administrative laws and systems and the innovation of the concept of AM. Chapter Three An Analysis of the Inevitability of the Reform of China's AEA System. AEA reform is an inevitable demand of China's social and economic development on the AM reform. On one hand, this demand results from defects of AEA itself. For examples, the range of AEA responsibility is not clear and sometimes the range is even too broad; the AEA has too many links and the procedures are too complicated and time-consuming; the low openness and non-standard lead to the abuse of the free judgment; AEA power is out of proportion to its responsibility; such phenomenon as more stress on AEA than on supervision and so on. All these have limited the development of free competition and creative economy, caused deficiency, corruption and the self-appreciation of Administrative Approval and have given rise to the false idea of power worship, thus suspending the foundation of the law-governed economy. On the other hand, China's AM reform and the entry to WTO confront the government with some new challenges, making the AEA reform inevitable. That is to get adapted to the WTO rules and to advance the reforms of AM system. AEA system is the only possible way to perfect the socialistic market economy and quicken the economic development.
