This paper was based on the spirits of the 16th National People's Congress and the 16th of the Communist Party of China 3th representative Congress, accorded to modern theory of property right, analyzed the defect that existed in state-owned enterprise's property relations, and then suggested the channel that state-owned enterprise makes effort to establish the modern property relations.Before the 16th Chinese Communist Party Congress, state-owned enterprise has carried out the reform that goes to system innovation from policy adjustment, which could not get material progress in the aspect of the reform of property relations. The state-owned enterprise could not become the main of market. Which make state-owned asset property right unhappiness, owner vacancy; After the state-owned enterprise's share-holding system is reformed, the structure of property right is still unitary; State-owned asset mobility difference can not realize the reasonable disposition of social resource. According to state-owned enterprise exist above abuse in establishment of modem property relations, this paper put forward state-owned enterprise will carry out system reform in three aspect: Include state-owned asset management system innovation , establish management patterns including state-owned asset management committee and state-owned asset's manage company and enterprise , which can make state-owned asset to realize capital person to position and the property right of legal entity; Thestructural diversity of property right, state-owned enterprise transform into share-holding system, reduces as far as possible the proportion taken by state-owned share, establishment mix ownership economy; State-owned asset flows reasonably and orderly , manages of state-owned asset from change to state-owned capital, establishment the trade system of property right, state-owned asset realizes insure and increment in value in circulation, which can make social resource optimum deploy.Now, the reform of modem property relations has got some progress. However, the present situation of reform still have certain gap with the modern property relations that the market of economic growth require, the state-owned enterprise's innovation of property relations is still far.
