Study On The APEC's Mechanism As An Region Economic Cooperation Organization

This paper consists of four chapters .The author puts forward the legal status of the APEC first in the Chapter One.Basing on the common concept and the characteristic of Regional Economic Cooperation Organizaiton ,together with APEC's tenet ,structure and practices,the author demonstrates that APEC fall within Regional Economic Cooperation Organizaiton.On the other hand,APEC has some particularities.The author further narrates the differences between the APEC and International Meetings and Intrenational Forum in the falling part,then, the author disscusses some question about the APEC's legal personality.Chapter Two exclusively discusses the APEC's basic structure and legal system.APEC's structure consists of Leaders Meetings,Ministers Meetings,Senior Official Meetings,some sub-committees , working groups and APEC Secretariat.The APEC's legal system comprises declarations,statements,initiatives,visions,etc. Such instuments are not treaties,but they have legal effectiveness. In the decisions-making and implementation affairs the APEC observes the rule of consenus and voluntarism. The APEC's member include state-member and non state-member,and people from commerce sector and academcies can also take part in the APEC's activities.Chapter Three mainly focus on the APEC's functions.Firstly,the author enumerates the basic principle of the APEC approach.secondly,the author describes the improvement in Trade and Investment Liberalization and Facilitation(TILF)and Economic and Techonology Cooperation(ECOTECH).Chapter Four is the conclusion of this paper.The biggest challenge that the APEC faced is the quick develpement of sub-region free trade in the Asian-pacific area.Regards with the reform of the APEC,the author thinks that strengthening of Secretariat status and due change in decision-making rule are valuabe.
