The relation between the state and the civil society lS anoticeable problem in recent years.We can say that it is a keyproblem of a constitutional government.The way of dealing with therelation in historical law is an aspect ofthe legal culture.In my view,it can embody the national legal life in the relatively basic meaning.This paper discusses the status of the Tang Dynasty governmentamong national life that the law reflected from three aspects,thestructure of the governmental power,the localizations of thegovernment,and the running of the power.The power of the TangDynasty government was made up of two parts.One part was theemperor standing higher above the masses;another part was thegroup of government officials。The emperor was a start ofthe power,and government officials were only the concrete subjects thatimplement the power.Through observing the main legal textmaterials ofthe Tang Dynasty,was from the functions and powers ofthe state,there was no clause that stipulates directly the emperor'Spower.The phenomenon did not mean the lack of the emperor'Spower;instead it was the effective assurance from which the imperialpower was fully exercised.The emperors regard their powerpresenting God'S will,therefore during the course of governing,healso need to follow the rule of the nature.The prevalence of thespecialization in government reflected the form of its power'Srunning in the late Tang Dynasty,and turned the nationaladministration into the emperor'S special authorization,whichreflected the supreme authority-the emperor'S attention to somespecific affairs.It led to people'S reliance on the government,insteadoftrust in the system.This state was caused by two factors,one is that the governmentattempted to manage many affairs as possible as it could;another isthat the people rely too much on the government.And these tworespects complemented each other.
