Regional Control Principle Of Environmental Law

The establishment of regional control principle is determined by the characteristics of modern environment and the rules of ecology.At the beginning of environment legislation, the establishment of the principle and the institution is focused on point source control, because point source pollution is the main characteristic of environment problems at that time. However, with the deepening of exploitation and utilization of environmental resources, environmental problems become more and more complex and diverse. The most remarkable presentation is the transformation of pollution from point source to regional source. Even after the point-source pollution is under control, the environment in all still can get worse and worse. At the same time, the ecological law illustrated by modem ecology forms the scientific foundation for sustainable development. Then some people hold that we should comply with the ecological law when we try to solve regional environment problems.Regional control is based theoretically on ecological law and the thought of sustainable development. On the side of pollution treatment, we should shift from point-source control to the regional-source control. In this respect, unified control and centralized management is needed. On the side of environment preservation, we should adopt comprehensive planning and establish nature reserve to exploit and utilize resources rationally and eternally.The concept of region in environment protection is not referred to as the manmade compulsory administrative area. It refers to the nature area on the basis of the natural geographical feature. According to it, the regional control principle is established to comply with ecological law and the feature of environment. The principle embodies the idea of the sustainable development.Despite the importance of regional control, it used to be discussed on the technological level. Therefore, it is necessary to demonstrate the essence of regional control and make it systematical. This dissertation tries to systematize the theory of regional control through generalization of elementary institution and administrative measures of the environment law. The purpose is to form a principle of environment law ,which can guide the practice of environment protection.
