On The Protection Of Prisoner's Human Rights

This thesis is a study on the protection of prisoner's human rights. The Chapter of preface, states some arguments about the ideas of prison and puts forward the problem to protect the prisoner's human rights. The study on the problem to protect the prisoner's human rights is significant to reflect the functions of prison, comment the prisoner correctly, understand the nature of prisoner's human rights and construct the legal system of prison.The study in the Chapter on the theory, Chapter 2,is focused on the concept of prisoner's human rights .The concept, characteristics, origin and form of prisoner's human righs are analyzed systematiclly. This Chapter explains that prisoner's human rights is a part of the systerm of human rights and that the theory of prisoner's human rights is a part of the theory system of human rights. The third Chapter, the Chapter on the basic theory to protect prisoner's human rights. The reasonable reason to protect prisoner's human rights bases on five aspects such as the value of power, realization of human rights, construction of law by rule, development of prison and civilization of the mankind. Chapter 4, the Chapter on the obstacle to protect the human rights. Puts forward the obstacles are from ideas, politics, economy, legal system and culture, etc. These problems formed under hisrorical conditions are restricting the protection and realization of human rights of prisoner.The last Chapter is on the legal protection of prisoner's human rights. According to the revelant international documentaries, the Chapter provides some ideas to protect the rights in the legislation and emphsises the functions of the prison, court, procuratorate and public security bureau in the judicature.
