The labor right is a fundamental human right that should be owned by every single person and shared by the whole society. Although prisoners'personal freedom and political rights have been deprived of, their labor rights are preserved by the law. Protecting and ensuring prisoners'labor rights can not only affirm the personal values of laboring, but also act as a necessary way to build legal prison management.In this article, we discuss the existing problems when prisoners are fulfilling their labor rights. Based on the prison law, we categorize these existing problems and analyze the underlying factors,including the imperfection of laws and regulations, the imperfection of supervision mechanism, and the concept of retribution. These problems may hurt prisoners' rights of resting, laboring, getting relief, and obtaining remuneration by labor. To effectively protect the labor rights of prisoners, set up their correct values, and teach them skills for survival when they return to society, by referring to the basic principles established by relevant international conventions as well as the basic national conditions of our country, we propose a set of protection methods for labor rights from the aspects of guiding ideology, laws and regulations perfection, and prison police law enforcement improvement.
