Run to today, the tenet of serving the people has evolved into "authority being exerted by the common people, benefit being sought by the common people, affection being tied with the common people". When put into effect, i.e. into administrative legislation, it represents itself as the requirement that administration and legislature should always stick to the fundamental of "Orientation towards the people", and embodies public opinions in the articles of rules and regulations. 3 parts in composition, this paper discusses the reason why administration and legislation of real estate should be in accordance with "Orientation towards the people" and how to do it by analyzing the concept of administration and legislation, and then put forward countermeasures and suggestions for the reference to real estate operators of administrative legislation departments. Public authority, in essence, is entrusted by citizens, therefore, the institution of public policies is the exertion of public authority and oriented toward the common people as a matter of course.The be-all and end-all of constructing socialist democracy also lies in maintaining the balance of public authority and civil rights. Administrative legislation should regard protecting civil rights as its starting point in reason. To our party, the root of establishment, the base of being in power and the source of strength depends on the support of the whole nation. It's necessary to carry out the important thoughts of "Three Represents" in proceeding guidelines and policies set down by the party and government. As a task, administrative legislation is the process of legalizing those guidelines and policies; undoubtedly, it should be oriented towards the people.Among the general's four basic necessities of life [clothing, food, shelter and transportation], real estate is in service of supplying shelter. To date there has been an increasing level of housing privatization in China. "Citizens' legal and private property shall be inviolable." As real property, real estate, especially those residential dwellings, is the most principal property for the commons. For this reason, administrative legislation of real estate should be more oriented towards the people, serve them conscientiously and safeguard their interests. 2. Sticking to the principle of "Orientation towards the people" in real estate administrative legislation"Orientation towards the people" is the basic principle of administrative legislation. In the first place, implement the administrative thought of "Orientation toward the people", e.i. thought of responsible government, hought of service government. Legal forms shall be employed in regularizing responsible properties on administrative behaviors. Three relationships should be concerned and handled correctly, they are: the one between governmental administration and self-determination of citizens, artificial persons and other organizations, the one between governmental administration and market mechanisms and the one between governmental administration and industries or intermediary organs.
