On The Actuality Of PSACM

Public Security Administrative Coercive Measures (PSACM) is a very important administrative measure for the public security organization. There are many problems for both academic research and social practice of PSACM, which make systematic analysis and research of PSACM necessary for theoretical and practical demand. There have been some theoretical research and exploration of PSACM which only covered some sectional problems or explained from the point of the Administrative Procedure Law.The purpose of this paper is to solve the problems of PSACM existing in practice and deficiency in law-making with the practical experiences of the Public Security Administration.Because there exists misunderstands and misuses of the concepts and forms of PSACM at practice, the paper firstly analyses the connotation, denotation and concept of PSACM from the point of notion and legal feature of PSACM. Meanwhile the paper organizes and sums up the current measures of PSACM with the use of frequently-used administrative codes and regulations of Public Security Organization.The writer has attention to make the readers comparatively and clearly understand the conceptions, features and types of PSACM according to the analysis of the first part.With the solvement of the basic problem, the second part analyses the problems of PSACM existing both in theory and at practice, which draw the attention of law-making to make the system of PSACM perfect in future. Under the fermentation of administrative coercive law, the paper considers the ways to make PSACM perfect at the point of practical implementation but not of law-making. The last part intends to use five ways of PSACM to more importantly and directly guide the practice of PSACM under the current legal structure.
