judge is the subject of the judicial action, so the judge system is really important. As the judicial reform goes ahead, judge system reform, especially the specialization of the judges comes to the main research topic. Therefore, the judge personnel system becomes to a new reform sample. In the reality, personnel system and the judicial clerk system have a very close relationship, and both of them come to elementary effect in the reform, while, there are different models for themselves. While in the same time, there are so many insurmountable problems in the judicial reform. So, we analyze the some distinct problems, such as the validity of the judge personnel system, the calculating standard for the personnel, the nature of party affairs and the administrative personnel, the social identification of the personnel system, and then show our theoretic analyzing path.
