The Disquisition On The Command Of Investigation

At present, in the research field of investigation, the research directions of it is mostly in the measures of investigation, the mechanisms of investigation and the strategies of investigation, seldom refer to the command of investigation research. Even if has a research on the command of investigation, it is just limited to the concept and content, is lack of systematic senses. Meanwhile, the limited researches are the reflection of the command of investigation on general criminal cases which mostly deal with by security department as well, and there is little research on the problem of the command of investigation about the crime by taking advantage of duty in procurator organization. As a result of this, there is a demand contradiction between a large amount activity of the command of investigation and little research, so, security department needs the theoretical direction in the practice. To this kind of situation, the author uses the method of the combination of theory and practice to research the command of investigation which is the core of investigation. The author chooses the command of investigation on the corrupt and bribe which is the main content of the crime by taking advantage of duty as the visual angle, on the basis of reviewing and summarizing his experiences of anti-corruption investigate practice in the past decades, uses research approach and theory that studied at school, summarized the command of investigation activity and summed up it, promoted it and make it become a independent system. At first, the author starts with such respects as the meaning, content, characteristic, function, principle of the command of investigation etc., established the theoretical system. Then, with bribe case as example, reflected the activity content of the command of investigation in different links of the investigation. Finally, aim at the limitations in the command of investigation; the author put forward some reformative suggestion ----the integration of the command of investigation. Because the field of the command of investigation is on the brisk of the study of criminal procedure law, there aren't mature research results in the theory field in home and broad. This dissertation is a tentative disquisition on the command of investigation and the author want to get some support and encouragement.
